The court appointed Theophilus Small as Guardian to James Hopkins, orphan -son of Peter, deceased. [2]
The court decided that T. Small was to pay James Hopkins 200 pounds tobacco yearly during the life of widow Hopkins; and to pay James 300 pounds tobacco yearly after her decease as rent.
Description of property in August 1772 as follows: one dwelling house 25 ft x 18 ft with a brick end & chimney; plank floored; outside in good repair; one side newly covered; one side bad- Must be covered; one small kitchen 12 ft x 10 ft with a brick chimney in tolerable good repair; one small milk house 6 ft x 6 ft in good repair; one tobacco house 30 x 20 in good repair; 70 apple trees -middle aged; 20 young & small apple trees; 3 small cherry trees; 2 small balck english walnut trees; 30 good peach trees; 72 panels good fencing; 182 panels low & sorry fencing; no land to clear; no timber on land; nor scarce any firewood to burn.

James wrote & signed his Will on December 9, 1816- -my son John...land NOMINI during his natural life and no longer -then land NOMINI to Nicholas Small (son of Nicholas Small) -my negro woman Sarah be free immediately after my death -my granddaughter Elizabeth (daughter of son John) negro child named Jane until age 25 then freed -residue of estate divided equally between my 2 granddaughters: Elizabeth (dau. of son Peter) and Elizabeth (dau. of son John). -appoint Nicholas Small my executor
Will was proved on April 27, 1819
He had 2 sons- Peter (deceased) and John.
