Thomas Kipps the eldest son was baptised on 5 May 1611 and married Margaret Chilmed, (Chilmaid) on 9 May 1653 at Kemsing, and they had three children before Thomas was buried on 15 Nov 1669 at Kemsing. Margaret was known as widow Kipps when she died 18 Jan 1691, leaving a will dated 1687 and proved in 1692 in which all her property was left to children Thomas and Margaret. Margaret probably daughter of Thomas Chelmed and Mary French. The two brothers, Thomas (1611-1669) and William (1614-1694) disputed ownership, leading to a Chancery Pleading court case (Kipps v Kippes 1663, TNA ref C6/23/64 - complaint and answer manuscripts). William Kipps defendant to a Bill of Complaint of Thomas Kipps 2 Jan 1663, who had entered an agreement that Thomas was to pay William £10 on the death of their father in exchange for his share of a messuage worth £30 and William wanted to ensure that this did not affect the one third due him on the death of his brother John. I think Thomas has made a Bill of Complaint that he does not have possesion of his share of the messuage left by his father. The messuage was left in equal shares between the four sons in Gavelkind, which was a system of land tenure associated chiefly with the county of Kent. Under this law, land was divided equally among sons or other heirs. William made an agreement with Thomas to surrender or lease his portion of the messuage in exchange for ten pounds payable on their father’s death. William says he layed out ten pounds or more on care of his ailing father, and when Thomas inherited the personal estate of their father, to which presumably he was sole heir, William asked to be paid back the ten pounds he had spent on their father in his final years. William received ten pounds and Thomas thought that settled the bond and was hence entitled to William’s portion of the messuage, presumably a quarter, but also William’s third of the quarter given to an unnamed brother who had died or relinquished it, thus a full third William on the other hand thought the ten pounds had been to repay the money spent and that he had not received the bond at all and hence had every right to enter the premises, and further thought that the deed with Thomas he only gave his quarter and was still entitled to keep the third of a quarter from his other brother.
