Email posted to the Garrett Co. Rootsweb mailing list by "Edith Chaney" <Feb. 12, 2001 ">from the DESCENTS RECORDS of Frederick County Md. SIX, Henry, the elder d/ 7 Oct. 1799, intestate- (Pg 78-81) widow & 10 children." The 10th was: "also, deceased daughter Sophia w/o Abraham MOON & their children......John & George MOON, minors." Edith goes on to say "It appears this is the same Abraham MOON that settled in Garrett County, Md."... "Originally this name was spelled SYKES and SEIKS and they came from Berks Co., Pa mid 1700's...." (By Samuel Bowser)

DESCENTS - Court Records from 1794 - 1837

About 1788, there was an Act of Assembly passed entitled "Act to Direct Descents". This act ensured an equal distribution to the heirs of a person who died without a will. The widow was given one third of the property including at least part of the home dwelling and included the best part of the property. If the land could not be divided equally, it would then be offered to each child (or brothers and sisters if no issue) by order of birth. If they chose to take the property, they would then have to pay the others their equal share of the appraised value within a specified time period. If all heirs refused to take the property, it was then sold at auction to the highest bidder subject to the widow's dower (she had a life estate) and the proceeds divided equally among the heirs. This of course after all debts had been covered.

If the heirs were minors (under 21 for a male and under 18 for a female), a guardian (representative of the minor who is of age and will act in the best interests of the minor) would be assigned for them or they could choose one. The commissioners who handled the case could also be selected by the heirs.
