Deed

This Indenture made the fourth day of December in the year of our Lord one thousand eight hundred and seventy eight, between George M.D. Hart as Administrator of David B Deputy, late of Appoquinimink Hundred, New Castle County and State of Delaware, deceased, of the first part, and Nathaniel Williams of St George's Hundred, County and State aforesaid, of the second part.
Whereas, at an Orphans' Court of the State of Delaware held at New Castle on the eighteenth day of February A.D. 1878, upon two applications of said George M.D. Hart administrator as aforesaid, it was ordered by the Court that the said administrator should sell at Public Auction, the premises hereinafter described for the payment of the debt of the said David B Deputy, deceased.
And whereas in pursuance of said Order the said administrator after due and legal notice of the time and place of sale of said premises did on the 11th day of May A.D. 1878, expose the same at sale at Public Auction and sold the same to said Nathaniel Williams for the sum of two hundred and twenty dollars, which sale upon return thereof made by said administrator was confirmed by said Court at the September Term 1878, and the said administrator ordered to make a Deed of said premises to the purchaser as aforesaid, as by the order of said Court will fully appear. Now this Indenture witnesseth;
That the said George M.D. Hart as administrator as aforesaid for and in consideration of the sum of two hundred and twenty dollars lawful money of the United States, to him in hand paid by the said Nathaniel Williams at and before the sealing and delivery thereof, the receipt whereof is fully acknowledged, had granted, bargained, sold, aliened, released and confirmed and by these presents and by authority of the Order of Court aforesaid, does grant, bargain, sell, alien, release, and confirm unto the said Nathaniel Williams his heirs and assigns, all that certain lot, piece, or parcel of land situate in Appoquinimink Hundred, aforesaid, adjoining lands of Dr James T Crawford, James I Moore and ending on the public road leading from Townsend to a corner, the lands of which are as follows;
Beginning on the said Public Road at a Bridge over the South prong of Carr Branch, thence with the several water courses of the said South Prong to when it and the North prong intersect, and from the main stream of said Branch; thence with the said North prong and lands of James I Moore to the aforesaid Public Road, and thence with the several water courses of said Road to the place of beginning, containing seven and one half acres of land be the same more or less, with a one story log house and frame kitchen thereon. It being same premises conveyed to said David B Deputy by Nathaniel Williams deed dated February 19, 1872 and recorded at New Castle in Deed Record C, volume 10, page 315, and together with all and singular buildings, improvements, ways, waters, water courses, rights, liberties, priveleges, hereditaments and appurtenances whatsoever thereto belonging or in anywise appertaining and the revisions and remainders, rents, issues, and profits thereof; and also all fee, estate, right, title, interest, use, trust, possession, property, claim and demand whatsoever, of the said David B Deputy, by him and immediately at the time of his death in law, equity, or otherwise howsoever, of, in, to or out of the same, to have and to hold, the said lot, piece, or parcel of land hereditaments and premises hereby granted and released, as mentioned and intended so to be with the appurtenances, unto the said Nathaniel Williams, his heirs and assigns, and for the only proper use and behoof of the said Nathaniel Williams, his heirs and assigns forever.
And the said George M.D. Hart as administrator as aforesaid for himself his executors and administrators doth covenant, promise and agree to, and with the said Nathaniel Williams, his heirs and assigns, by these presents, that the said George M.D. Hart as administrator as aforesaid has not done, committed or knowingly or willingly suffered to be done or committed, any act, matter or thing whatsoever whereby the premises hereby granted, or any part thereof, is, all, shall or may be or may be impeached, charged or incumbered, in title, charge, estate, or otherwise howsoever

On the 10th day of December Anno Domini 1878, before me Joseph Roberts a Notary Public for said State, personally appeared the within named George M.D. Hart, administrator of David B Deputy, deceased, and as such administrator and in due form of law acknowledged the within written Indenture to be his act and deed and desired the same might be recorded as such. Witness my hand and Notarial Seal, the day and year aforesaid.
