Transcript of the Will of Robert Walter SHERWIN

(1859 - 1944)

This is the Last Will and Testament of me Robert Walter Sherwin of 65 Victoria Road North and of 5 Hampshire Terrace both in the City of Southampton Solicitor.

1. I revoke all previous Wills and Testamentary dipositions made by me.

2. I APPOINT my son-in-law WILLIAM MEIKLE and my daughter MINNIE ELS1E SHERWIN to be the EXECUTORS AND TRUSTEES of this my Will.

3. I BEQUEATH the following specific legacies free of duty:

(a) To my daughter Lucy Ethel Reeves the six Steel Engravings of Landseer Dogs in my Dining Room.
(b) To my son Charles Ernest Sherwin my Gold Watch with my Initials engraved on the back.
(c) To my daughter Mabel Alice Meikle my two Cut Glass Decanters and Coasters part of the presentation to me from my Masonic Lodge.
(d) To my daughter Kathrine Edith Tipper the Marble Clock in my Dining Room presented to me on my marriage by the South Sea Rowing Club.
(e) To my son Joseph Cecil Sherwin the Marble Clock in my Breakfast Room.
(f) To my daughter Minnie Elsie Sherwin the Tray and three sets of Candelabra presented to me by my Masonic Lodge and I also bequeath to the said Minnie Elsie Sherwin such articles of furniture and household effects in my house at 65 Victoria Road North as she may select sufficient to furnish Number 4 Sandringham Road Petersfield or if she decides not to live at such house sufficient to furnish any other house in which she may live.

4. I DEVISE AND BEQUEATHto the said Minnie Elsie Sherwin free of duty my freehold house at Number 4 Sandringham Road Petersfield aforesaid for the duration of her life and so that the said Minnie Elsie Sherwin shall be responsible to keep the said premises fully insured and in a proper state of repair and to pay all rates taxes and other outgoings in respect thereof and so that upon the death of the said Minnie Elsie Sherwin the said prenises shall fall into and form part of the residue of my Estate.

5. I BEQUEATH to my son Thomas Miles Sherwin free of duty the Goodwill of my Practice as a Solicitor together with the Office furniture books and effects used in connection therewith and also all the furniture and household effects at 65 Victoria Road North aforesaid not hereby otherwise specifically bequeathed and not selected by my said daughter Minnie Elsie Sherwin as aforesaid.

6. I DEV1SE AND BEQUEATH all the residue of my Estate whether real or personal and wheresoever situate not hereby otherwise disposed of unto my Trustees Upon trust to sell call in and convert into money the same or such part thereof as shall not consist of money and with power to postpone such sale calling in or conversion for such period as my Trustees in their absolute discretion may think fit and out of the monies produced by such sale calling in and conversion and out of my ready money to pay my funeral and testamentary expenses and debts

And I direct that my Trustees shall stand possessed of the balance of the proceeds of such sale calling in and conversion and all such monies Upon trust to appropriate and set aside a sum of Six thousand pounds and invest the same in or upon such securities as my Trustees shall in their absolute discretion think fit and to pay the income to arise from such sum or from the investments for the time being representing the same to my daughter Minnie Elsie Sherwin during her life free of duty and upon her death I direct that the sum of Six thousand pounds or the investments representing the same shall fall into and form part of the residue of my Estate

And I direct that my Trustees shall hold the residue of my Estate Upon trust for all my sons and daughters in equal shares absolutely free of duty.

7. I DIRECT that all rents profits and income accruing due after my death from such parts of my estate as shall for the time being remain unsold and unconverted shall be paid by my Trustees and applied for the benefit of the person or persons to whom the proceeds of such sale or conversion would be payable if such sale and conversion had actually been effected.

8. I DECLARE that any Trustee for the time being of this my Will being a Solicitor is to be entitled to charge and be paid out of my Estate for all business done by himself or his firm in proving this my Will and generally in administering and winding up my Estate as fully as if he were not a Trustee including matters which a Trustee might have done personally.

IN WITNESS whereof I the said Robert Walter Sherwin the Testator have to this my last Will and Testament set my hand this 11th day of April One thousand nine hundred and thirty nine.

SIGNED by the said Robert Walter Sherwin the Testator as and for his last Will and Testament in the presence of us both present at the same time who in his presence at his request and in the presence of each other have hereunto subscribed our names as Witnesses.

PROBATE

In His Majesty's High Court of Justice The Principal Probate Registry

BE IT KNOWN that Robert Walter Sherwin of 65 Victoria Road and of 5 Hampshire Terrace both in the City of Portsmouth died on the 10th day of February 1944 at St. Mary's Hospital, Portsmouth aforesaid.

AND BE IT FURTHER KNOWN that at the date hereunder written the last Will and Testament (a copy whereof is hereunto annexed) of the said deceased was proved and registered in the Principal Probate Registry of His Majesty's High Court of Justice and that Administration of all the Estate which by law devolves to and vests in the personal representative of the said deceased was granted by the aforesaid Court to William Meikle of 13 Merton Road Southsea Portsmouth aforesaid medical practitioner and Minnie Elsie Sherwin of 65 Victoria Road North aforesaid spinster daughter of deceased the Executors named in the said Will.

And it is hereby certified that an Affidavit for Inland Revenue has been delivered wherein it is shown that the gross value of the said Estate in Great Britain (exclusive of what the said deceased may have been possessed of or Entitled to as a Trustee and not beneficially) amounts to £ 16,078 - 5 - 3. and that the net value of the personal estate amounts to £ 5,327 - 13 - 10. And it is further certified that it appears by a Receipt signed by an Inland Revenue Officer on the said Affidavit that £ 450 - 7 - 3 on account of Estate Duty and Interest on such duty has been paid.

Dated the 1st day of March 1947

NOTES: 1. Robert has put in the Will his address as Southampton, whereas it was clearly Portsmouth, he may have meant "City of Portsmouth in the County of Southampton"

2. Clearly his wife is no longer alive at the time he drafted this Will.

3. He has six children and probably Minnie was the youngest and was drafted in to look after the old man after the death of his wife.

4. The eldest child was probably Lucy Ethel and in order to find his wife we will first have to find the GRO reference to Lucy Ethel's birth after 1881 and work from there.
