Transcription of Lease
Oct 29th 1869 An article of agreement entered into between W. M. Ball of the first part, and Charles Nunn of the other part, both of the County of Union State of Ky. I W. M. Ball have this day given Charles Nunn, of color, a leese on my place on fourteen acres of ground. This here embraces a long square. I J. W. Ball of the first part do agree to let the said Charles Nunn have the leese for four years and in return the said party of the second part does agree to clear up the land eighteen inches and under and put the same in a high state of cultivation with a ten rail merchentible fence around the thirty acres the part of the second part puts up one Tobacco barn the logs to be twenty two feet long and neatly ?ulssed the timber to be lasting, the barn to be six tiers and a half high, and build another room to the dwelling and build a smoke house, hen house, corn crib and stable such as suits the second party, the party of the second agree to build a crop fence through the leese and should there be a surplus of board timber or rail timber on the leese the party of the second part is to make it up for the party of the first part by the party of the first part , laying a reasonable price for the make up the timber the poplar timber on the said leese the parties get it out for saw stocks, each party to be out half the expense of getting out and hauling and divide the lumber equal between the parties, the leese to be sown as much as one or two years in wheat, the timber on the leese is to be used for the benefit of the same except what is specified and at the expiration of the said six years to leave the fence under a ten rail merchantable fence embrasing the crop fence the ground well cleared up eighteen inches and under with no down timber brushes or briars to obstruct the same, the leese to be completed the first or second year the leese not to be transferred without the consent of parties it is on that the party of the party of the second part has the privilege of joining his fence to th party of the first part by keeping up a good ten rail fence the second party is not to join fencing with anybody except the party of the first part the party of the second part agrees not to put up any public House.

I John H. Wall clerk of the Union County certify that the foregoing agreement between Wm. M. Ball and Chas. Nunn, was on the 25 of Jany 1870 produced to and before W. E. Swearingen, my Deputy acknowledged by said Ball & Nunn to be their act and deed as appears from endorsement thereon towit “1870 Juny 25” – ack’d by W. M. Ball & Chas Nunn of color & O. C. att. W. E. S. D. C.” and on the 4th day of March 1870 the same was ordered to be and is together with certificate truly recorded in my office. Witness my hand this 16th November 1872.
