I Daniel Quare Citizen and Clockmaker of London do make and ordain this my last Will and Testament in manner following that is to say
First I give and bequeath unto my dear and loving Wife Mary Quare Daughter of Jeremiah Stevens late of Wickham [High Wycombe] in the County of Bucks Maltster dec'd [deceased] the sum of two Thousand eight hundred pounds lawfull money of Great Britain I also give unto her all my household goods and implements of household I also give unto her the two Gold Watches she usually wears one of them being a Repeater and the other a plain Watch And I do hereby declare that what I have hereby given unto my said Wife in [?] and full satisfaction of what she can or may claim of or out of my Estate by the Custom of the City of London or otherwise howsoever And that she do and shall within three Months next after my Decease sign seale and duly execute and deliver unto my Executor a Release accordingly
Notwithstanding I did fully advance my late Daughter Anne now dec'd [deceased] upon her Marriage with John Falconer of London Merchant yet out of the Affection I bear to the Children of my said Daughter viz John David Mary and Margaret Falconer I give unto each of them the sume of four hundred pounds Sterling to be paid unto them respectively at their respective ages of one and twenty years And in case of the Death of any of them before his or her Legacy shall become due then I give the Legacy or Legacies of him or her so dying to the Survivor and Survivor of them And I do hereby declare that the Legacys before given to my Grandchildren the said John David Mary and Margaret Falconer are given to them as aforesaid upon Condition that their Father the said John Falconer do and shall within the Space of two Months next after my decease sign seal and duly execute unto my Executor or his Executors or Administrators a Generall Release of and for all sume and sums of Money Claims and Demands whatsoever that he the said John Falconer can or may have or claime of into or out of my Estate for any matter Course of thing whatsoever except what is hereby given him And I do hereby further declare that the Legacys before given to my said Grandchildren the said John David Mary and Margaret Falconer is upon this further Condition That each of them respectively do and shall upon his or her Receipt of his or her Legacies sign seal and duke execute unto my said Executor His Executors or Administrators a general Release of all Claimes and Demands of in or to my Estate by the Custom of London or otherwise howsoever Except what he or they may be intituled to by this my Will and that the Legacy of him or her that shall neglect or refuse to give such Release shall go and be to my said Son Jeremiah Quare
Item I give to my said Son in Law John Falconer five Guineas
Item I give unto each of my Grandchildren Daniel and Mary Quare Children of my Son Jeremiah Quare the Sume of four hundred pounds Sterling to be paid unto them respectively at their respective ages of one and twenty years And in case of the death of either of them before his or her Legacy becomes due I give the Legacy of him or her so dying to the Survivor of them
I do hereby declare that I did fully advance my said Son Jeremiah Quare upon his Marriage yet I hereby give and bequeath unto him the Sume of two Thousand pounds Sterling
Provided always and my Mind and Will is that in case my Estate shall fall short of paying the Legacys hereby given then the said several Legatees (except my said Wife) shall allow to my Executor a deduction out of the several Legacies hereby given them in proportion to what my Estate shall fall short of paying thereof
All the rest residue and remainder of my Estate (if any) I give unto my said son Jeremiah Quare and constitute and appoint him Executor hereof and revoke all other Wills by me at any time heretofore made
In Witness whereof I have to this my last Will and Testament sett my hand and seal this third day of May in the year of our Lord one Thousand seven hundred and twenty three
Memo that the above written Will was read to the Testator Daniel Quare and then the same was by him signed and sealed and also published and declared to be his last Will and Testament in the presence of Harbt. Springett Joseph Seward Dan. Reading
