There has been an Abernathy practicing law in Collin County continuously since 1876. The Abernathy brothers moved from Holly Springs, Mississippi, to McKinney then. The three brothers, Mercer Green, William Meshack, and G. E. (Ed), were all attorneys. Abernathy Brothers Law Firm opened in McKinney in 1876. In 1888, Mercer was elected county judge. William Meshack Abernathy served in the Confederate army. After the war he walked home to Mississippi. He graduated from the University of Mississippi in 1868 and from Cumberland University’s law school in 1871. He married Lucy Roberts and practiced law in Ashland, Mississippi, for several years before moving to Texas.
William Meshack Abernathy served McKinney for many years as one of the early fire chiefs of the volunteer department; he also served as president of the Texas Fireman’s Association. He helped organize Saint Peter’s Episcopal Church in McKinney.
G. E. (Ed) Abernathy opened an abstract office in McKinney and dealt primarily in real estate, leasing and land titles.
Mercer Green Abernathy’s son, Jewell E. Abernathy, Sr., served two terms as county attorney and was elected county judge in 1936, an office he held until his death in 1941. In 1921, Jewell, Sr. served as an attorney for the last man hanged in Collin County, Ezell Stepp. Jewell Sr.’s two sons were Mercer Abernathy and Jewell, Jr. Mercer was killed in World War II. He was a navigator on a B-17 Flying Fortress bomber.
