Disputed Origins

[Note: Mother's name is Unknown. Will of Edmund Hurd of Claxon, written November 20, 1626, (may be a synopsis of the actual will) names: Sister Agnes Bussy, widow. It does not identify her as his wife. He also names sons - eldest Luke when he attains age 21, Henry and Edmund; daughters eldest Grace, youngest Katharine. See: NEHGR: Vol. 51: p. 423]

Luke Heard's place of origin is unknown. He arrived in 1639 at Newbury, and also resided at Salisbury and Ipswich, Massachusetts. [1]

Inheritance

Luke Hurd, not yet of age 21, is named as eldest son of Edmund Hurd, of Claxon, Norfolk, England, in Edmund's will, written on November 20, 1626 and proved on December 4, 1626. [3] [4]

Life in Massachusetts Bay Colony

On September, 6 1639, Luke Hearde was made Freeman, Massachusetts Bay Colony[6][7]

  • Luke Heard was among those who received a lot in the first division at Colchester. [8]
  • 1647: March 30: Luke Heard was on the Jury of Trials. [9]

Marriage

Luke married about 1642, Sarah Riddlesdale. Sarah was baptized at Assington, Suffolk, England on November 16, 1623, daughter of Edward and Mary (unk) Riddlesdale. [10]

Death

Luke died in September, 1647. After his death, his widow married Joseph Bixby. [10]

Will, and subsequent Legal Proceedings

Luke Heard left a nuncupative will which was proved on 28: 7: 1647 [September 28, 1647]

I give to the following:
  • wife Sarah, sole executrix
  • eldest son John L10, when he reaches age 21
  • son Edmund, L5, when he reaches age 21
  • my books should be equally divided between my sons
  • my sons should be brought up in reading and writing so they may choose trades
  • Witnesses: John Wyatt and Simon Tompson[13] [14]

His estate was inventoried by John Wyatt, James How and Thomas Howlett. {Ipswich Deeds: Vol. 1: leaf 33] [13]

December 15, 1647 [15: 10: 1647]: Bond of Joseph Bexby (Bixby) and widow Sarah Heard fo L30 for the two children of Luke Heard, iinen weaver, as the above parties intend to marry. Agreement is that the children will be taught to read and write, any by the age of 13, each will be apprenticed to learn a trade as ordained by Nathaniel Rogers, their grandfather Wyatt and Mr. Howlett. [13][9]

Further, that any lands owned in Assington, Suffolk, England which were to be Sarah's after her mother's death, if not detained, will be solely Sarah's, and Joseph Bixby will have no right to them after their marriage. [Essex County Quarterly Court Files: Vol 1: leaf 95] [13] [9]

Nathaniel Rogers and John Wyatt petitioned the General Court to fulfill the will of Luke Heard, due to the fact that Joseph Bixby being out of the country, with no estimate of his return. The court ordered an attachment to the estate of Joseph Bixby as a guarantee of the children's legacies, as the estate of Joseph Bixby has been 'so weakened'. Heard-662 and Heard-160 appear to represent the same person because: While the birth and death date estimates in -662 are slightly different from those in -160, and the former profile is much less detailed and sourced, these are clearly profiles of the same person and therefore should be merged and differences reconciled. I'm willing to do the recoiciliation, but the project managers should carry out the merger
