Probate

Att a Town Council held in Scituate in the County of Providence &c: on ye 6th. Day of February Annoque Domi: 1743/4...

Whereas Ishmael Wilkinson of Scituate aforesd. Departed this Life on the 3d. Day of November AD 1742: and Dyed Intestate and Sarah Wilkinson Widow of the Said Ishmael Wilkinson Deceased; being by the Town Council of sd Scituate appointed administratrix to his Personal Estate; And She being now Dead; It is Voted and ordered that Uriah Mowry and Benjamin Wilkinson both of Smithfield in the County aforesaid Take an Inventory of all the Personal Estate of the Said Sarah Wilkinson Deceased as She was administratrix to the Estate of her Said Deceased Husband Ishmael Wilkinson in order to Exhibit the Same to the Next Town Council[1]

At a Town Council held in Scituate in the County of Providence &c: on the Eighth day of February Annoqe Dom: 1743/4...

Whereas Sarah Wilkinson of Scituate aforesaid Widow Departed this Life on the Third Day of February AD: 1743 and Died Intestate. She being administratorix to the personal Estate of her Husband Ishmael Wilkinson Deceased and Benjamin Wilkinson appeared before this Council and Prayd. that he might have Letters of Administration granted to him on Said Personal Estate upon Consideration whereof it is Voted that Letters of administration upon Said Personal Estate Shall Not be granted to the Said Benjamin Wilkinson for Certain Reasons

and Jonathan Mowry of Smithfield appeared before this Council and Prayd. that he might havve Letters of administration granted to him on the Estate of his Sister ye Said Sarah Wilkinson Deceased who was administratrix as above Said

Whereupon it is Voted that Letters of administration on the Personal Estate of Sarah Wilkinson above said be granted to the Said Jonathan Mowry upon his Procuring of Sufficient Bondmen and he Procured Capt. Zebedee Hopkins of Glocester and Uriah Mowry of Smithfield both in the County aforesaid who were accepted by Said Council

Whereupon the said Benjamin Wilkinson Prayd an appeal upon the above Said Vote to the General Council which is Granted upon his Complying with the Law Made and Provided in Such Cases

and the said Jonathan Mowry Zebedee Hopkins and Uriah Mowry were all bound accordingly and he had Letters of administration on Said Estate granted to him in the following words

There are in his Majesties Name George the Second King of Great Britain &c: to authorise order and Impower you the Said Jonathan Mowry to take into your Possession Care and Custody all and Singular the goods Chattels Rights and Credits of the Said Sarah Wilkinson Deceased as She was adminstratrix as above Said and the Same to administer according to Law and in all things to act and do as the Law Requireth and Impowereth administrators Relateing The Premise And True and Perfect accounts to Render to this Council or their Successors when you are thereunto Lawfully Called how you have administer Said Estate with other your Doing thereon; And for your So Doing this Shall be your Sufficient Authority

Given at a Town Council the Day and Year above said and Signed and Sealed by order of sd Council P[er] Gideon Harris Their Clerk

And Uriah Mowry and Benjamin Wilkinson acording to their orders from the Last Town Council Exhibited an Inventory of the Said Sarah Wilkinsons Personal Estate in the following words, Vizt.

A True Inventory of all and Singular the Goods Chattles Rights and Credits of Sarah Wilkinson of Scituate in the County of Providence Deceased (Administratrix to the Estate of Ishmael Wilkinson of Scituate aforesaid) who Departed this Life on the third day of this Instant February: Appraise this Seventh day of February AD: 1743: by us the Subscribers

And the Said Uriah Mowry Benjamin Wilkinson and Jonathan Mowry all Declared that they had put all the Personal Estate of the Said Sarah Wilkinson Deceased as she was administrx as above sd into this Inventory that was come to their Knowledge whereupon it is Voted that the above Inventory be accepted and allowed to be a good and Lawfull Inventory and accepted to be Recorded[3]

Att a Town Council Called by a Warrant and held in Scituate in the County of Providence the 25th. Day of February AD 1743...

Whereas at a Town Council held in Said Scituate ye 8th. Day of this Instant February: Capt. Jonathan Mowry was by sd. Council appointed administrator to the Personal Estate of Sarah Wilkinson Deceasd (as she was administratix to the Personal estate of her Husband Ishmael Wilkinson of said Scituate Deceasd and the Said Jonathan Mowry appearing before the Council this day Refused to administer on Said Estate

And Benjamin Wilkinson appeared before this Council and Prayd that he Might have Letters of administration on the Personal Estate of his Brother Ishmael Wilkinson Deceased and of his wife Sarah Wilkinson Decd.

Whereupon it is Voted that Letters of administration on the Personal Estate of the Said Ishmael Wilkinson and Sarah Wilkinson Shall be granted to the Said Benjamin Wilkinson upon his giveing and with Sureties for the True Performance thereof and he Procured Isaiah Angell and Thomas Angell Junr. both of said Scituate to be his bondsmen who were accepted and all bound accordingly and he had Letters of administration granted in the following words

And the Said Benjamin Wilkinson Declared on Engagement before this Council that he has put all the Personal Estate of the Said Ishamel Wilkinson and Sarah Wilkinson Deceased into the Inventory of Said Estate which is Recorded on the foregoing Leaf of this Book that is yet Came to his Knowledge and that if a[ny] thing More other hereafter appear he will add the same to be the aforesaid Inventory. Test Gideon Harris Council Clerk

Whereas Sarah Wilkinson obtained from the Town Council of Scituate aforesaid a Letter of administration on the Personal Estate of her Husband Ishmael Wilkinson of Sd. Scituate Decased. She giveing bond with Suretys for the True Peformance of Sd. Administration and She Procured Uriah Mowry and Jonathan Mowry both of Smithfield to be her bondsmen who were all bound according to Law and the Said Sarah Wilkinson being Dead the Said Uriah Mowry and Jonathan Mowry appearing before this Council and bringing of Proper Receipt for Debts Paid out of Said Estate with the Inventory that was taken Since ye said Sarah Wilkinson Death amounting to Ninty three Pounds More than the Total of the first Inventory that was Exhibited to the Council after the Death of the Said Ishmael Wilkinson whereby it appeared to this Council that She had Truely administred Said Estate and Benjamin Wilkinson haveing Letters of administration granted to him on the Personal Estate of the Sd. Ishmael Wilkinson and Sarah Wilkinoson Deceased

It is Voted and ordered that the Said Uriah Mowry and Jonathan Mory Shall be acquited from Said Estate and these bonds Canceled

Test Gideon Harris Council Cler

Voted and ordered that the Said Benjamin Wilkinson Lott out the Said Ishmael Wilkinson deceased his farm to the best advantage for one year and Take Care of his Children.[4]
