THE INQUEST.
An inquest was held this day before Mr. A. H. Boyd, coroner, and the following jury:- George Silas Parsons (foreman), and Arthur Griffiths, Samuel Lovel, Fredk. Harris, George Harris, James Bell, and George Mitchell, touching the death of Thomas Oates.
Henry Oates stated he was in company with the deceased at about 6 o'clock on Wednesday evening at the Picnic Hotel, Huonville, and remained there for about an hour, and then lit the lamp of deceased's cart. Deceased left at about 9 o'clock. No one was with him. When witness next saw him he was dead. This was at half-past 9 o'clock this (Thursday) morning. He was then lying with his head turned under him. The cart was by his side. Witness examined the tracks of the cart, and found one wheel had struck a log which was lying in the road, and had turned over. Deceased was his brother.
William Henry Cordwell stated that he resided with his father at Mountain River. On Wednesday night at about 12 o'clock he was on his way home from Mr. Fleming's, and his attention was attracted to a cart lying overturned on the roadside. On going near he heard a horse groaning. It was lying in the shafts of the cart. He lit a match but it was so windy he could not get a light. He then went for a man named Mark Murrell, who was camped near, and he at once accompanied witness to the spot where the accident had occurred.
He then discovered it was Thomas Oates' cart. He lit a candle and discovered the body of deceased. He appeared to be quite dead. Witness went for the assistance of Mr. Griffiths, and on his arrival they took the horse out and raised the cart up. It was lying bottom upwards. On raising the cart deceased was lying on the back of his shoulders with his head under him. He was quite dead.
Witness found on examining tho spot that a log was lying about 3ft from the middle of the road. Witness saw the impression of the wheel on the end of the log. The cart was turned over on the other side of the road.
Mark Murrell stated that on Wednesday night he was called up about 12 o'clock by the last witness, who said, "Come quickly. Tom Oates' cart has got capsized." On arriving at the spot they found the cart bottom upwards, and the horse was in the shafts. They lit a candle, and saw deceased lying under the cart. He appeared to be dead. He was doubled up, lying on the back of his shoulders, with his head under his chest. On obtaining the services of Mr. Griffiths and Mr Cordwell they raised the cart. The deceased's body was quite cold.
Henry Cordwell stated he resided on the Mountain River, and was called up by his son between 1 and 2 o'clock. He said, "Father, get up, and come quick." He (witness) got up and went out, and then his son told him a cart was capsized on the road, and he believed it was Tom Oates'. Witness went to the spot and helped to remove the cart, and found deceased was quite dead. He was lying with his head doubled up under him. Deceased was about 39 years of age. Witness examined the locality, and found that one wheel of the cart had struck the end of a log on the road. The collision must have been a very violent one, for the cart was completely turned over.
Dr. H. M. Madden stated that he was called up to view the body of the de- ceased. Thomas Oates, lying dead on the side of the road, at Mountain River. He found the body in the exact position in which he fell, namely, with his head and neck bent under his body. Witness considered that death must have been instantaneous.
The Foreman stated that he considered it his duty to call attention to the fact that the log which had been the cause of the accident had been allowed to remain where it was for the last three months.
Without retiring, the jury returned a verdict that deceased had come to his death accidentally, casually, and by misfortune.
Deceased was a mill proprietor, the son of Mr. Charles Oates, of Mountain River, and much esteemed by all who knew him for his many good qualities.
