Various persons named John Gater or Gaither have been confused or conflated in order to provide an English pedigree for an American Gaither family. No Trans-Atlantic connection has been found between the Gaters of Lamberhurst, Kent, England, and the Gaithers of Virginia and Maryland, North America. John was a popular name in more than one Gaither family. They will be designated as follows in the biographical narratives of each profile:

Biography

1620 Birth and Family

Mary Walters was likely in Chelsea, Middlesex, England, the town where she was later married to John Gaither. Nothing is known of her specific birth date, or the names of her parents.

Birth Year Estimation

Since she was married in 1642 and probably her first marriage, assume she was aged no more than 22 at the time, hence born, say, 1620.

Sibling

She was probably the sister of Henry Walters of Lower Norfolk County, Virginia, who died in 1646. (see below)

1642 Marriage to John Gaither

The register of St. Luke's Church, Chelsea, England records that "John Gather and Mary Walter was married ye last of October Anno 1642." [2][3]

By September 1642, appointing Thomas Marsh as his attorney in his absence, John Gaither had returned to England. [3]

John Gaither had previously been married to Joane/Jane, who is presumed to have died prior to Gaither's return to England. [4]

No record of John and Mary's return trip to Virginia has been found. [4]

1646 Death of Henry Walters

In 1646 as John Geather he was administrator as "brother-in-law" of the estate of Henry Waters/Walters. [5]

1649 Consents to Land Transfer; Move to Maryland

1949 John Gaither and his family joined other Virginia Puritans in relocating to new lands in Maryland which they named Providence, and later became Anne Arundel County.

On 12 July 1649 Mary Gater, wife of John Gater, consented to the transfer of land to John Godfrey. [6]The land, consisting of 800 acres, was transferred from John Godfrey to Thomas Dadford on 16 January 1653/1654 and stated to have been originally granted to John Gather by patent on 26 July 1638. The 1638 grant included land granted to Gaither for transporting his wife Joan, confirming that it was the same John Gaither who married first Joan and then Mary.

1652 Deaths

On 24 Nov 1652, in Anne Arundel Co, MD, letters of administration were issued on John Gaither's estate to his widow Mary. [7]

No record has been found of Mary's death, which would have taken place some time after 1652, presumably in Anne Arundel County, Maryland.

Children

John had one known child, born in the mid 1640's and therefore the son of Mary. That he was the son of Mary and not Joan is supported by his naming a daughter Mary, and at least four of his children did the same. [4]

Mary, wife and relict of John Gaither, was reliably a Waters as claimed by Gaither Family Genealogist, Fredric Z. Saunders. The circumstantial evidence is convincing in this regards and credit is due Saunders for his research and identifying Gov. Berkeley's Commission of Administration to "John Geather."

In late 1645 "Henry Water" of Lower Norfolk County, Virginia died "intestate leaving an estate of divers goods rights and creditts. In care whereof John Geather hath made [16 February 1645 (old style)] humble suite to the County Court... that a Commission of Administration ~ might be granted unto heirs of his said estate as brother in law to the said deceased." John Geather thereby claimed that he was one of multiple heirs of Henry Water. On 16 October 1646, Gov. Berkeley did "give and grant unto the said John Geather the administration of all and singular the goods rights and creditts of the estate of the said deceased."

As is typically the case, the record leaves something to the genealogist to deduce. To do so one must rely on sound reasoning including the Law of Parsimony or "Occam's Razor" in common parlance; vis: "entities should not be multiplied beyond necessity" oft paraphrased as "the simpler explanation is more likely to be correct than the complex one." So, the two possible explanations based on the record are that John Geather had 1) a sister married to Henry Water or 2) a wife whose brother was Henry Water. The first possibility should be dismissed employing Occam's Razor as it adds unnecessary complexity to the explanation in that it requires creation of a fourth person - John's sister - who is not in the instant or broader record. It should also be dismissed because John would not be an heir to his sister's husband's estate as he claimed in his suit. That leaves the simple explanation afforded by the record that John Geather was heir-at-law to Henry Water's estate as the husband of Mary Water, Henry's sister and natural heir.
