Eventually, Salem, Ipswich, Charlestown, Cambridge, and Boston all had jails filled to capacity. Scholars have attributed the lack of trials for the accused to the fact that there was no legitimate form of government at the time available to try the cases. However, it has been found that other capital cases were tried during this time period. The fact remains that none of the witchcraft cases were tried until late May with the arrival of Governor Sir William Phips. Upon his arrival, Phips instituted a Court of Oyer and Terminer (to "hear and determine") and simultaneously appointed William Stoughton as the Chief Justice of the court. Stoughton was a man with several years of theological training but no legal training. By then tragedies had already occurred, including Sarah Osborne's death before trial of natural causes. She died in jail on May 10. Sarah Good's infant child also died in jail.

John DODGE's, now belonging to the children of said William DODGE, deceased, partly in Beverly and in Salem , containing 54 acres, with house, barn and mills, being all set out in a deed of gift from Captain John DODGE, to said William DODGE. Also 4 acres of fresh meadow and 3 acres land in Proctor's Island, Chebacco. He died intestate, and his administrators, among whom was his wife's brother Ebenezer WOODBERY, leased the land and mills his father had deeded to him, including John WOODBURY's homestead, to Jonathan DODGE, William's brother. The lease was toextend 7 years from 1 Apr 1709.
(4) 1710, 7 Jun: Ebenezer WOODBURY deposed that he was present Oct 1702 at Capt. John DODGE 's house and was witnessed to the transcation between said John DODGE and his son William and set his hand as witness to the deed, andsaid William gave a deed back to his father or his brother Jonathan, as his father desired 11 acres in Beverly and also surrendered a dwelling house to said father or brother Jonathan for him which he had built on a piece his father h ad given him by word of mouth.
(5) 1720/1, 21 Mar: William DODGE's real estate was divided. The saw mill became the proper ty of William DODGE's son-in-law, Samuel WOODBERY, another son-in-law Joseph CREESY, and a minor daughter, Abigail. Away, 1 1/2 rods wide, was reserved for the use of the heirs, who also had the privilege of raising the water when it was needed at the mill and of flowing the land from Oct 31 to Apr 10 so long as the mill was "Repareable." Not only Capt. John DODGE's property lying west of the head of Bass River, but also that east of the river and the brook, the land which had been John WOODBERY's, passed through Capt. John DODGE's son William DODGE to the latter's son-in-law, Samuel WOODBERY.
