1. John M. McLehany is first seen on a marriage record to Elizabeth Womack dated 3rd January 1822 in Amite County, Miss. The name is spelled thrice in the document as “ John M. McLehany”. The co-signers of this document are David Womack(Elizabeth’s father) and Jesse Mains. Simpson County did not become a County until 1824, that explains why the license came from Amite County. Amite county, formed 1811, is on the southern edge of Mississippi right next to St. Helena Parish in Louisiana(where Elizabeth Womack is from). In the 1820 census of St. Helena Parish, LA, Elizabeth is living with her father, David Womack.
NOTE: The book "Amite County, Miss., 1699-1865 Vol. I" has a list of inhabitants in 1816-No McLehany or Womack was recorded.
2. Sarah A. McLehany is born to John & Elizabeth on April 9, 1823 in Louisiana. John was definitely living near the Womacks in Louisiana. They also appear to have followed her father, David Womack, north to Simpson County, Mississippi. Nancy J. McLehany is born July 15, 1825 in Mississippi so the family travelled from Louisiana between April 1823 and July 1825.
2. John McElhany is shown on the census for Copiah County, Miss. This census has 1 male under 5(William), 1 male 30 to 40(John M.), 2 females under 5(Nancy J. & Harriet), 2 females 5 to 10(Sarah A. & Unknown), 1 female 20 to 30(Elizabeth). Since the names of only heads of household is given, I am speculating as to names but all the ages are correct for John M. McLehany's family. There is 1 extra female 5 to 10 that I can't identify. They live next door to Abner Warmack which would most likely be Elizabeth's relative. I believe there is enough circumstantial evidence to say that this is my John McLehany in Copiah county in 1830. It is helpful to note that Copiah is next door to Simpson County and in 1840 John disappears from the Copiah census and appears on the Simpson County census. It's possible that John did not move because Simpson County was formed from Copiah County in 1824, one year after Copiah County was formed.
3. John M. McLehany is second seen on the 1840 Census for Simpson County, Miss. The spelling is shown spelled as J.M. McLenhany. In this census he is living close to several Womack’s including David Womack which would be Elizabeth's father. All the dates are correct for John's family.
4. John M. McLehany is third seen on the 1850 Census for Simpson County, Miss. The spelling is shown as John McLenhany. William McLehany (his son) is living next door to him and his name is spelled McLehany. Also close by are Miles J. Cook and his wife Nancy(McLehany). This census shows his birth in Tennessee and he is 52 years old ߝ that would make him born about 1798.
5. John M. McLehany is fourth seen on the 1860 Census for Simpson County, Miss. His name is spelled John McLehany. He is 63 years old and born in Tennessee. That would make him born about 1797.
6. John M. McLehany is fifth seen on a land grant dated 2 April 1860. He has claimed 319 acres of land in Simpson County, Miss. On this document his name is spelled John McLehaney. (Note that his son William claimed 159 acres next door to John ߝ William’s name on his land grant is spelled William McLehaney with the “e” crossed through. This is an indication that they were aware of the proper spelling at the time since the effort was made to correct the spelling of the McLehany name)
7. John M. McLehany is sixth seen on the 1870 Census for Simpson County, Miss. The spelling is shown as John McLehany. His age is 74 and he was born in Tennessee.
8. David D. McLehany petitions the Chancery Court of Simpson Co. on Oct 3, 1872 to revive(revise?) the will of John McLehany, Dec'd. The Proof of Will for John is dated
July 1, 1872. John must have died shortly before July 1, 1872.
HISTORICAL NOTE:
In 1816, General Andrew Jackson, who commanded the Army district at Nashville, was instructed by the war department to construct a "military road" between Nashville and New Orleans. The road was completed in 1820 for a total of 516 miles, an improvement of 200 miles over the "Natchez Trace".
John McLehany married Elizabeth Womack in Amite County, Mississippi in 1822 and Amite County is just across the state line with Louisiana and the road from New Orleans and is also not far from the city of Natchez, Mississippi. It is likely that John, who was born in Tennessee, travelled one of these routes in his migration. The rich soil of the new Mississippi Territory (created in 1798) and the demand for export of textiles started a great migration.
In 1798 when the Territory of Mississippi was formed from the Western section of what was then Georgia, it included what later became the Territory of Alabama. Shortly after that Territory had been formed, Mississippi became a state on December 10, 1817. At the completion of the Louisiana Purchase in 1803, thousands of settlers rushed into Mississippi for available land.
Many of these land seekers were former residents of New England communities and some of the southern states along the Atlantic coast. Another tremendous migration into Mississippi, sometimes likened to the 1849 gold rush into California, came in a four year period ending in 1837 when the last of the Indian Lands in Mississippi had been opened for settlement. Most of those acquiring this land came from the eastern section of the nation.
The following is from Reba Cook, descended from Sarah A. McLehany:
According to Willie Mae Ponder Cook, the red hair in her family came from the McLehaneys. A Sarah McLehaney, age 10 and a Jacob McLehaney, age 14,[ie b abt 1856] was in John's household in 1870 Simpson Co., census (probably grandchild His son James H left a wife(Cindarella) and child(Sarah when he was killed in the Civil War). Unable to determine John's parents, but there were three Mcelhaneys (different spellings) in 1820 TN census - John and Henry in White Co and Joseph in Williamson Co., none of whom have a male of age to be subject John. A John McElhaney supposedly left a will in Robertson Co., TN in 1819 - WB 3, pp 47-48. Note: I have looked at the will of John McElhaney of Robertson Co., TN and could not find anything that would link him to my John M. McLehaney.(Tom McLehaney)

That said Testator appointed the said Mrs Elizabeth McLehaney Executrix of said last will and testament who subsequently renowned her right to execute said will in favor of our petitioner. Which said renunciation and petition and said will were on file in the office of the Clerk of the Chancery Court of said County preparatory to having the same admitted to Probate when the same was destroyed on the night of the 9th of May AD1872, together with the records of said County by the burniing of the Court House at that time. That said last will and testament was signed and attested - by
W.T. May G. Walker and P.H. Overby as subscribing witnesses to the execution and publication of said last will and testament all of whom now reside within the jurisdiction of the Court.
Your petitioner therefore prays your Honor that said parties be cited to answer this petition and show cause if any why said last will and testament should not be substituted and revived and admitted to Probate as containing bequests, legacies, claims, donations and disposition of real and personal property as stated in this petition.
That said decedents personal estate was worth not exceeding seven hundred dollars according to petitioners estimate and is now all in the possession of said widow, except what she has used.
Upon a final hearing hereof your petitioner prays your Honor to admit such substituted will to Probate, after causing the testimony of said witnesses to be taken in this behalf and that your Honor will appoint him Administrator of said decedent with the will amended. Your petitioner tenders the names of

Subscribing witnesses to a certain instrument of writing purporting and alleged to be the last will and testament of John McLehaney deceased personally appeared in open Court who after being first duly sworn deposed and say in oath that the said John McLehaney signed sealed published and declared a last will and testament the date of which is not now remembered of the tenor and effect stated in the petition of D.D. McLehaney on file in said Court praying for a substitution and revival of said Will that said testator at the time of “Signing Sealing and Publishing” said last will and testament was over twenty one years of age and of sound disposing mind and memory. That said testator signed sealed published and declared said instrument of writing in the presence of the said P.H. Oberby G. Walker and W.T. John M McLehaney is my "brick wall" and I am asking for help with any information. Due to DNA testing I am sure that the name changed from McElhaney(or variant) sometime before John. I would love to hear from McElhaneys(or variant) who have DNA tested.

My brick wall has been solved through DNA testing results finding relative cousins. I'm grateful for those who tested making this possible. Tom McLehaney
