Tom was born in Dunlap, Sequatchie County, Tennessee, on January 11, 1892 the son of T L Stewart, a County Trustee, and Mary Fricks, a Music Teacher.[1][2]
He graduated from Emory College (now Emory University) then obtained his law degree from Cumberland University in Lebanon, Tennessee. He was admitted to the bar in 1913.
He was district attorney general of the eighteenth circuit of Tennessee 1923-1939, He was the chief prosecutor in the July 1925 John Thomas Scopes trial.
In April 1937, Senator Nathan L. Bachman died while in office. Tom Stewart entered the race to fill the vacancy. He defeated George L. Berry, who had been appointed by the governor, in the Democratic primary. He was elected as a Democrat to the United States Senate on November 8, 1938, for the term ending January 3, 1943. He didn't assume his senatorial duties until January 16, 1939 when his current term as District Attorney expired. He was reelected to the Senate in 1942 however he was not renominated in 1948. He was the chairman of the Committee on Interoceanic Canals (Seventy-ninth Congress).
After serving in the Senate, he resumed the practice of law and died in Nashville, Tennessee on October 10, 1972.[3] He was buried in Memorial Park Cemetery, Winchester, Tennessee.[4]
