Note NI2786The parental relationship between Andrew Paine and his father Willis Andrew Payne is not proven but is a good posibility given the information available. It is presented here for discussion. There is also a possibility that this Andrew Paine is the father of William Andrew Weavil (Weavil-21). We think it is either this Andrew Paine or Willis Andrew Payne (Payne-1158).

Census: 1830 TennesseeSmith, TN/Page 29 (1194 anc): Andrew Payne: 0002001000000--0000101100000. Andrew's 1830 census entry in Smith Co. is as follows: (page 29, line 21). Andrew PAYNE. 2 males 15 and under 20; 1 male 40 and under 50; 1 female 20 and under 30; 1 female 40 and under 50; 1 female 50 and under 60; 1 male slave under 10; 3 female slaves under 10; 1 female slave 24 and under 36; Total - 11. This age is a little different than the 1840 and 1850 census records and I suspect is closer to his actual age - born 1780s.

On 23 Dec. 1802 in county court minutes Joel DYER was appointed guardian for Reuben HALL, age about 6. At same session of court, there is a will mentioned for one John PAYNE and also an estate for one Elizabeth HALL. Also at same session Isaac JOHNS is appointed guardian for Margaret HALL, age about 9. It would seem Elizabeth HALL was mother of Reuben and Margaret but no idea who their father was.

Smith Co. TN Roll 44, County Clerk Minutes, Vol. 15, February 1834 - Nov. 1835, page 587. 2 Sept. 1835. "On motion Andrew PAYNE is appointed guardian to Reuben HALL, a Lunatic, who came into court and together with Samuel HOWARD and A. B. HUBBARD, his securities, entered into bond in the sum of three hundred dollars conditioned as the law directs.".

Smith Co. TN County Clerk Minutes, 1799 - 1804, 1835, WPA Transcript, page 194, Microfilm V202, Roll 78. 30 Nov. 1835. On motion ordered that Andrew PAYNE be released from all further liability as Guardian of Reuben HALL, after he settle his guardianship and return also the effects in his hands belonging to the said HALL to him.

Census: 1840 Tennessee/Warren, TN: A. Payne: 2200010000000--0110010001000. 1840 Census: Bradley TN, Andrew Payne, One male only age 40-50. This must have been Andrew after he left in the middle of the night to escape his financial problems. Must have left his family above behind? However ages in 1830 and 1840 census don't add up? 40 to 50 in both census records?.

TN, page 93 (handwritten), post office - McMinnville - dwelling 689, family 689, lines 22 - 25. Andrew PAINE, age 65, Farmer, 0 real estate, 0 personal estate, born NC. Ann, age 42, born VA. Joel, age 13, born TN. Andrew, age 6, born TN. In the 1850 census for Warren County, Tennessee, taken October 16, 1850, Dist. 14, page 92, Andrew is listed as a laborer.

Census: 1870 TNWarren/Dist. 15/Page 161A (520 anc): Andrew Paine (83), VA; Anna (65), VA; Andrew (15), TN. 1870 Census, Warren Co. TN, page 161, 15th Civil District, post office - McMinnville, dwelling 29, family 31, lines 24 - 26. PAYNE, Andrew, age 83, Farmer, Real estate - 0, personal estate - 0, born VA. Ann, age 65, Keeping House, born VA. Andrew, age 15, Farm Laborer, born TN.

Though this place of birth is inconsistent with the others, the age gives a birthdate for Andrew of about 1787. Andrew appears to have died by 1880 as Anna, age 70, is listed as widowed, and living with her son A. H. PAYNE that year.

A big inconsistency in the age of both Andrew and Ann from 1860 census to 1870 census. Who are all the individuals in the household in 1830 and 1840?.


Chancery Book 1 Records 1824-1871:

Andrew Jenkins to Andrew Payne a bill of sale 30 Oct 1833.

Bradock Beasley to Andrew Payne a bill of sale of tobacco 14 Nov 1833.

William Davis versus Andrew Payne: The bill of complaint of William Davis of Smith Co. against Andrew Payne of Bradley Co. about Sept 1837, said Davis purchased of the said Andrew Payne a tract of land containing about 100 acres for which he agreed to give Payne 0 of which 0 paid down. Said Payne was very much involved in debt at the time he made the contract. He actually left the country (county) before 10 days had expired or very soon thereafter within which time he was to make title to the land. Complainant has heard that he has settled in Bradley County in this state. Complainant appealed to him for a deed to said land, but said Payne positively refused to make a deed. Said Payne has sold the notes to one John Payne (could this be Captain John Payne? ) of this county. The complainant is willing to pay the whole of the purchase money provided he can get a title. 11 Jun 1837. (pp 153-155).

Chancery Book 2. William Payne and others versus George Oldham and others: Andrew Payne became much embarrassed in the month of Oct last absconded and left the county privately leaving a good deal of property both real and personal, but not enough for the payment of near all his debts. Attachment was resorted to 22 Jan 1838 (pp 67-81).

Robert Nickson versus Joseph Dickens et al complainant begs to show that one Andrew Payne, late of Smith Co. about the month of Oct 1837 absented himself from said county. He was indebted to a large amount, but left a considerable estate, both real and personal. The creditors of said Payne proceeded to attach said property. A controversy arose among creditors as to their said priority of claiming. 18 Feb 1829 (pp 131-145).

Jameson and High versus William M. Payne and others. The bill of complaint of Jeremiah Jemeson and Belen H. High, citizens of Smith County against William M. Payne of Smith County and Euselius and Andrew Payne who are non residents. Prior to month of Oct 1837, the said Andrew Payne, the father of the said William and Euselius, lived in Smith Co. and became very much in debt. He had for several years previous to that time been engaged in the business of freighting tobacco from this state to New Orleans. He had conducted his business very loosely and carelessly. He sustained considerable losses by advancing money upon tobacco to persons who very often tobacco nor other means to refund the advanced money. (typed as written) He has become indebted to the complainants. 19 Aug 1839. (pp 145-153).

Bolen D. High and Jeremiah Jameson versus sons William M. Payne and Euselius Payne, and father Andrew Payne: The defendants are allowed to give bond with good security. 29 Aug 1839 pg 516.

William Davies versus Andrew Payne. The clerk and master is to give an account 26 Feb 1840 (pp 544-545).

Davis versus Andrew Payne. Complainant has paid to the defendant 0, the full amount of the purchase money. 11 Aug 1840 (pp 566-567).
