It appears that Malcolm died about 1528 On 15 August 1528 At the Place of Conventical Friars of Dundee,it was acknowledged that Silvester Haldane of Keilour had received £21 Scots as part payment of 80 merks in name of Elizabeth Ogilvy, James Ogilvy, Janet, Alexander and Margaret Ogilvy's children of the late Malcolm Ogilvy his executors and Margaret Ouchterlony their mother.
