LAND: 1840, Ontario County, Brock East Tp., Abstract Index to Deeds, Vol. A. 1800-1958. G.S. 4810. May 22, 1840, Land patent to Nehemiah Avery, 100 acres, Lot # 23, 10th concession. North. by April 30, 1862 Nehemiah Avery had sold all this land. In Feb 1868 Joseph Avery, Nehemiah's son starts buying this land back (671) and puts a mortage on land (714) March 4, 1871 and continues to buy and sell pieces of this lot until Aug 11, 1893. (6726).

IN HIS MAJESTY'S SURROGATE COURT OF THE COUNTY OF YORK

BE IT KNOWN that upon search being this day made in his Majesty's Surrogate Court of the County of York, it plainly appears that on the twenty eighth day of July A.D. 1911, the last WILL AND TESTAMENT of JOSEPH AVERY late of the City of Toronto in the County of York, Gentleman, Deceased, who died at Toronto on or about the twenty fourth day of April A.D. 1911, and who at the time of his death had a fixed place of abode at the said City of Toronto, in the said County of York, was proved and registered by WILLIAM FRAYER of the said City of Toronto, carpenter, the Executor therein named and which said probate now remains of record in the said Surrogate Court. The true tenor of the said Probate is in the words following, to-wit:

CANADA; PROVINCE OF ONTARIO. IN HIS MAJESTY'S SURROGATE COURT. in the County of York.

BE IT KNOWN that on the twenty eight day of July in the year of our Lord one thousand nine hundred and eleven THE LAST WILL AND TESTAMENT of Joseph Avery late of the City of Toronto in the County of York and Province of Ontario Gentleman, deceased who died on or about the twenty fourth day of April in the year of Our Lord one thousand nine hundred and eleven at Toronto in the County of York and who at the time of his death had a fixed place of abode at Toronto in the said County of York was proved and registered in the said Surrogate Court a true copy of which said last will and testament is hereunder written and that the administration of all and Singular the property of the said deceased and anyway concerning his will was granted by the aforesaid Court to William Frayer, of the city of Toronto, aforesaid Carpenter, the Executor named in the said will he having been first sworn well and faithfully to administer the same by paying the just debts of the deceased and the legacies contained in his will so far as he is thereunto bound by law and by distributing the residue, (if any) of the property according to law and to exhibit under oath a true and perfect inventory of All and Singular the said property and to render a just and true account of his Executorship whenever thereunto lawfully required.

I, Joseph Avery, Gentleman, formerly of Forest Grove, in the State of Oregon, U.S., Farmer, but presently residing at 303 Concord Avenue in the City of Toronto, Canada, being desirous of settling my affairs, in the event of my decease, and having full confidence in the person afternamed as Trustee and Executor, Do hereby give, grant, assign, convey, and make over to and in favour of, William Frayer, Carpenter, 303 Concord Avenue, in the City of Toronto, as Trustee, and in trust, for the purpose after mentioned, the whole estate and effects, real, and personal, presently belonging to me and that shall belong to me at the time of my decease.

And I nominate and appoint the said William Frayer to be sole Executor and Administrator. But declaring that these presents are granted in Trust always for the purpose aftermentioned.

To my daughter, Martha Frayer, wife of the said William Frayer (hereinbefore mentioned as my Executor and Trustee) I give, devise and bequeath, all of my estate, both real and personal, and consisting of moneys in the Dominion Bank, Toronto, Canada, Building and lot in Forest Grove, State of Oregon, one note for the sum of Four Hundred Dollars given by George Cardwell of Forest Grove, State of Oregon, one note for the sum of one hundred dollars, given by Archie Black of Port Perry, Ontario, Canada.

In Witness Thereof I have hereby set my hand and seal this twenty second day of March, nineteen hundred and eleven, before witnesses hereunto subscribing.
