James was born at Launceston, Tasmania in 1812. James was tried at Launceston on August 21st 1834, for the same theft as his brother Edward was tried for earlier in the year. James was also sentenced to life. He was described at the time as being a farm labourer, 6'1, having a fresh complexion, with brown hair and dark brown eyes. No chances were being taken with James and he was sentenced to Norfolk Island. He was transported to Sydney on the Lady Kennaway and from there sent to Norfolk Island.
In 1841 James placed a petition saying that New South Wales natives who were convicted of cattle theft had been removed from Norfolk Island to the mainland in 1838, and being a native of the colony, he could not see why the same ruling was not applied to him. His petition was successful and he was removed to Hyde Park Barracks in Sydney. James received his ticket of leave in the first quarter of 1843 whilst assigned to Mr Bolton at Pitt Water and an absolute pardon on September 15th 1845.
