against

John Taylor Junior devisee and Executor &c of Samuel Benton deceased, Mrs. Frances Benton, Lam Benton and Augustine Benton - Defendants

Charles Bruce is of Guilford Co., NC
Mark Mangum is of Wake Co., NC
Penny Benton “late of the County of Wake deceased…” She died on or about 1 Mar 1772, intestate.
Penny Benton left her mother, Mrs. Frances Benton, and Lam Benton, Augustine Benton and Samuel Benton, her brothers, and Betty Bruce and Martha, your oratrix, her sisters.
Samuel Benton, her brother, was granted administration on her estate.
The complainants allege that Samuel Benton “possessed himself” of Penny Benton’s personal estate and real estate.
Samuel Benton wrote his will on 28 August 1810. The will says he left to his son in law John Taylor the younger of Hillsborough, all the residue of his estate, and he appointed John Taylor and Duncan Cameron of Orange Co., NC, as executors of his will.
Samuel Benton died on the [blank] day of October 1810.
John Taylor was granted Letters Testamentary by the Orange Co. Court on Samuel Benton’s estate.
The complainants then allege that John Taylor “possessed himself” of Samuel Benton’s personal and real estate.
Charles Bruce says his wife, Betty, was entitled to 1/6 part of Penny Benton’s estate. Betty died in Guilford Co., NC, on the [blank] day of March 1799, intestate. Charles Bruce was granted Letters of Administration on his wife’s estate, and he is now entitled to his wife’s share of her sister’s estate.
Mark Mangum and his wife, Martha, married on the [blank] day of [blank] and at that time Mark Mangum became entitled to a share of Penny Benton’s estate in right of his wife.
During her life, Penny made gifts to her mother, Frances, and brothers Lam and Augustine.
The complainants have asked John Taylor for an accounting and settlement of Penny Benton’s deceased. John Taylor has refused.
