Bell for the loss of the said negroes, so that they may enjoy their freedom agreeable to the intentions of this, my will - but if no compromise can be made so that they can enjoy their freedom, then the money so recovered from the said Hansbrough and Bell I give to be equally divided between Philip, Eliza, Mary Garnett and Caley children of Betty Packer and their heirs for ever - if either of them should die without leaving children or descendants of children then living, then the proportion of one or more so dying shall be equally divided among the survivors - I also emancipate and set free «b»Martha, Robert and Mary Louisa«/b», children of «b»Betsey«b», and the increase of the females. It is to be understood, that all the aforesaid slaves and the future increase of the females, are hereby emancipated and set free to all intents and purposes, and should there be any thing further to be done under the Laws of Virginia to complete their emancipation, I hereby empower my Executor hereafter named to carry into effect my intentions, by executing any instrument of writing that may be necessary.

I devise to my Executor hereafter mentioned the sum of two thousand five hundred dollars, to be laid out in the purchase of a tract of land for the young mulatto man Philip, emancipated by this will, in Ohio, or any other State he may choose, and that my said Executor convey the said tract of Land so purchased to the said Philip, to him and his heirs forever-But in case the said Philip shall die without leaving a child or children, then the aforesaid land to be equally divided between Mary Garnett, Eliza and Caley daughters of Betty Packer and their heirs for ever.

I give to Mary Garnett daughter of Betty Packer, the sum of one thousand five hundred dollars, to be laid out in land in Ohio or where she may wish to her during her natural life, and after her death to go to the issue of her body, living at the time of her decrease in fee simple.

  • 6«sup»th«/sup». I give to Caley daughter of Betty Packer the sum of one thousand seven hundred dollars, to be laid out in land as aforesaid, to her and her heirs forever. But if she dies without leaving issue then the land or money to be equally divided between Philip Eliza and Mary Garnett children of Betty Packer, to them and their heirs for ever.
  • 7«sup»th«/sup». I give to Eliza daughter of Betty Packer, the tract of land whereon she now lives in the State of Ohio, containing two hundred and eighty nine acres more or less, which I purchased of Joshua Woodson to her and her heirs for ever.

It is my will and desire that my Executor hereinafter named, cause all the aforesaid slaves emancipated by this will to be removed to the State of Ohio, or where they may choose to go in the United States, and to pay all expences of such removal, out of any monies in his hands belonging to my estate.
  • 9«sup»th«/sup». I give to Andrew for the use of himself and family (whom I have emancipated) a tract of land lying in the State of Ohio containing one hundred and thirty acres more or less, purchased of James Stafford , to him and his heirs for ever.

  • 11«sup»th«/sup». I give to Betty Packer whom I have emancipated, three hundred dollars.

I hereby emancipated my negro woman «b»Nelly«b», and my Executor his hereby required to retain in his hands or place at interest, as much money on landed security: and the Interest on said sum be applied to her support, to prevent her from becoming chargeable to the Parish or County.
  • 11«sup»th«sup» It is my will and desire that «i»not one «/i»of my «i»Brothers, Sisters, Uncles, Aunts, Nephews Nieces«i» or any of my relations, shall under any circumstances whatever, possess, enjoy or inherit any part of my estate; and in case there should be any difficulty in any of the Legacies contained in this will owing to any illegality in writing the same, or for any other cause; I do hereby empower my Executor herein after mentioned, to make and execute any instrument in writing, that may be necessary to remedy any defect in this will, and to carry my meaning and intentions into complete effect.

If either of the persons herein before mentioned, to whom I have devised a part of my estate, should die in my life time, the devise or bequest to such person shall not lapse, but shall go to the issue which said deceased legatee or devisee may leave living at the time of my death; but if there be no such issue, I give and bequeath the same to the said Philip, Eliza, Mary Garnett and Catey children of Betty Packer, to have and to hold to them and their heirs, under the same conditions and limitations and with the same remainder over, in the event of the death of either of them without issue) as directed in the fourth and sixth clauses of this will.

All the rest and residue of my estate, real and personal, which I have now, or may hereafter acquire, and which is not otherwise disposed of, I devise to be sold by my Executor; the real estate on a credit of one two and three years and the personal on a credit of twelve months, and that the proceeds thereof when collected, cash on hand, debts when collected, and the proceeds of all Legacies which may lapse by the death of the Devisee or Legatee in my life time, be equally divided among the children of the said Betty Packer, to wit: Philip, Eliza, Mary Garnett and Catey, to them and their heirs forever, and if either of them should depart this life before I do, leaving issue, then living, to wit; when I die, such issue shall represent and stand in the place of the deceased parent, and become entitled to that portion of my estate which such deceased parent, if alive, would have taken under my Will-But if either of the aforesaid children of Betty Packer should die in my lifetime without leaving a child, children or descendants thereof, living when I die, as aforesaid, or if either of them should die afterwards without leaving issue then living, it is my will and desire that the said share or portion of the one so departing this life, shall accrue to, and be equally divided among the survivors of the aforesaid four children of the said Betty Packer and the descendants of such as may be dead leaving issue (such descendants taking in that event the same share or portion of my estate, which their ancestor if alive, would have taken under this wil) to have and to hold to them and their heirs for ever - and whereas I contemplate giving to the said four children of Betty Packer in my life time a portion of my estate - if I should do so it is to be regarded as part of what I give by this will, and the devisee is hereafter in the division of my estate to account for the same, as if the said property had been delivered or paid over by my Executor in executing my will and in no other way or manner-Lastly I appoint my friend the Honorable Richard H. Note NI10278248. WILLIAM HANSBROUGH: (223 Peter) Born September 2, 1779; died unmarried on December 15, 1837.

On October 27, 1808, and October 17, 1810, he and George Tebbs were in charge of the Stevensburg Races. In 1812, George Tebbs advertised that he had given Mr. Hansbrough an interest in his school; that he would attend generally with him; that he had been with him for the past 12 years; that he was a young man of exemplary character, habits, and deportment; that he highly recommended him; that "in accomplishment of dancing he was excelled but by few.".

From his will executed May 13, 1836, it appears that William must have quarreled with his family, for the 14th Item of that instrument provides:

"It is my will and desire that not one of my brothers, sisters, uncles, aunts, nephews, nieces, or any relations, shall under any circumstances whatever possess and enjoy or inherit any part of my estate. . .".

At the time of his death, he was a very wealthy man. He directed the freeing of his slaves under the law of Virginia, and directed his executors to purchase tracts of land in Ohio or any state "where they May choose to go in the United States" for certain named slaves. He also gave fairly large sums of money to several of his slaves, and directed that the balance of his estate be equally dived among the children of Betty Packer, who seems to have been his favorite slave. 1

But if she dies without leaving issue then the land or money to be equally divided between Philip Eliza and Mary Garnett children of Betty Packer, to them and their heirs for ever. 7th. I give to Eliza daughter of Betty Packer, the tract of land whereon she now lives in the State of Ohio, containing two hundred and eighty nine acres more or less, which I purchased of Joshua Woodson to her and her heirs for ever. 8th. It is my will and desire that my Executor hereinafter named, cause all the aforesaid slaves emancipated by this will to be removed to the State of Ohio, or where they may choose to go in the United States, and to pay all expences of such removal, out of any monies in his hands belonging to my estate. 9th. I give to Andrew for the use of himself and family (whom I have emancipated) a tract of land lying in the State of Ohio containing one hundred and thirty acres more or less, purchased of James Stafford, to him and his heirs for ever. 10th. I give to King whom I have emancipated the sum of one hundred and fifty dollars. 11th. I give to Betty Packer whom I have emancipated, three hundred dollars. 12th. I give to Sally, whom I have emancipated fifty dollars. 13th. I hereby emancipated my negro woman Nelly, and my Executor his hereby required to retain in his hands or place at interest, as much money on landed security: and the Interest on said sum be applied to her support, to prevent her from becoming chargeable to the Parish or County. 11th It is my will and desire that not one of my Brothers, Sisters, Uncles, Aunts, Nephews Nieces or any of my relations, shall under any circumstances whatever, possess, enjoy or inherit any part of my estate; and in case there should be any difficulty in any of the Legacies contained in this will owing to any illegality in writing the same, or for any other cause; I do hereby empower my Executor herein after mentioned, to make and execute any instrument in writing, that may be necessary to remedy any defect in this will, and to carry my meaning and intentions into complete effect. 15th. If either of the persons herein before mentioned, to whom I have devised a part of my estate, should die in my life time, the devise or bequest to such person shall not lapse, but shall go to the issue which said deceased legatee or devisee may leave living at the time of my death; but if there be no such issue, I give and bequeath the same to the said Philip, Eliza, Mary Garnett and Catey children of Betty Packer, to have and to hold to them and their heirs, under the same conditions and limitations and with the same remainder over, in the event of the death of either of them without issue) as directed in the fourth and sixth clauses of this will. 16th. All the rest and residue of my estate, real and personal, which I have now, or may hereafter acquire, and which is not otherwise disposed of, I devise to be sold by my Executor; the real estate on a credit of one two and three years and the personal on a credit of twelve months, and that the proceeds thereof when collected, cash on hand, debts when collected, and the proceeds of all Legacies which may lapse by the death of the Devisee or Legatee in my life time, be equally divided among the children of the said Betty Packer, to wit: Philip, Eliza, Mary Garnett and Catey, to them and their heirs forever, and if either of them should depart this life before I do, leaving issue, then living, to wit; when I die, such issue shall represent and stand in the place of the deceased parent, and become entitled to that portion of my estate which such deceased parent, if alive, would have taken under my Will-But if either of the aforesaid children of Betty Packer should die in my lifetime without leaving a child, children or descendants thereof, living when I die, as aforesaid, or if either of them should die afterwards without leaving issue then living, it is my will and desire that the said share or portion of the one so departing this life, shall accrue to, and be equally divided among the survivors of the aforesaid four children of the said Betty Packer and the descendants of such as may be dead leaving issue (such descendants taking in that event the same share or portion of my estate, which their ancestor if alive, would have taken under this wil) to have and to hold to them and their heirs for ever - and whereas I contemplate giving to the said four children of Betty Packer in my life time a portion of my estate - if I should do so it is to be regarded as part of what I give by this will, and the devisee is hereafter in the division of my estate to account for the same, as if the said property had been delivered or paid over by my Executor in executing my will and in no other way or manner-Lastly I appoint my friend the Honorable Richard H. Field Executor to this my last will and Testament, revoking all others by me heretofore made-in witness whereof the said William Hansbrough hath hereunder set his hand and seal this 13th day of May 1836.
