Biography

Judah Levi was an early immigrant to colonial America and fought for indepence in the revolutionary war. His story however is somewhat unusual in that unlike most, who voluntarily emmigrated to America seeking religious freedom or adventure, Judah, at the tender age of 12, was banished to the colonies as a convicted criminal for 'stealing a 10 pence handkerchief'.

Judah Levi, son of Elias Levi, was born in London in October 1759. In 1771, at the Old Bailey criminal court in London, young Judah and an older relation, Elias Levi, were tried and convicted of theft of a handkerchief and sentenced to 7 years transportation and labor in the British colonies. Later young Judah's uncle, Henry Levi, is also implicated in the crime and similarly charged, convicted, and sentenced. All three quickly found themselves aboard Ship Justitia bound for the Rappahannock River in Virginia.

Between 1771 and 1777 Judah's whereabouts and history are unclear but in 1777 in Fauquier, Virginia Judah is found enlisted for 5 years in Colonel Abraham Buford's Regiment of Virginia Troops. During his enlistment, Judah is one of the few surviving Whigs from the Battle of Waxhaw occuring in South Carolina on 29 May 1780. This revolutionary battle, known as 'Buford's Defeat', was a decisive win for the British and was described as a 'massacre' due to the bloody manner in which the Loyalists killed and maimed their opponents. Judah survived this battle but was "desperately wounded in the head, left eye and thigh" and spent over a year as a British prisoner recovering from his wounds. On his parole, Judah returned to Virginia and re-enlisted until the end of the war. It is said he engaged in the Battle of Brandywine in 1777 under Lafayette's command.

After achieving independence, Judah returned to Fauquier County and married Mary McGraw, daughter of James and Jemima McGraw. His future father-in-law, James McGraw, also fought in the Battle of Waxhaw but did not survive. Judah and Mary's marriage was performed by John Monroe, a Baptist minister, on 22 October 1783 in Fauquier, Virginia.

In 1792 Judy Levi is living on land leased from Lord Fairfax in Fauquier county, '72 acres - for the lifetime of Judah Levi, Mary his wife and son Elias'. The lease requirements are to "build a dwellinghouse 20 feet long and 16 feet wide with a brick chimney and keep the same in good and tenantable repair. And further .. raise and plant an orchard of 100 apple trees and plant the same at least 30 feet asunder and keep the same well trimmed and fenced .. and not to waste, unnecessarily destroy, or dispose of any timber growing upon the land, but only to make necessary use of the same."

In about 1800, the Levi and McGraw families remove from Fauquier County, Virginia to Mason County, Kentucky. This group included Judah and Mary's family with 8 or 9 children and his brother-in-law's families, Cowither, Isaiah, and John McGraw.

During this time Judah Levi applied for military bounty land benefits but his initial attempt failed. A subsequent application for bounty land benefits was presented again in 1823, with Colonel Buford certifying that Judah had "many years before, put in the hands of William Marshall of Virginia, a certificate for the purpose of obtaining said Judas's military land warrant. William Marshall shortly after died, since which the certificate has not been found." This second application attempt also fails. Subsequent other attempts to secure bounty land continue into the 1840s by both Judah and his sons, Elias and Willis.

Judah was appointed Marketmaster in Maysville and later Tobacco Inspector. Judah was on hand to greet General LaFayette when he visited Maysville in May of 1825. He owned land both in the city of Maysville and on Bracken Creek, bordering Bracken County. Judah died on 24 June 1829, his obituary in the Maysville Eagle read "died Wednesday evening, Judas Levi, a soldier in the Revolution in his 67th year. His remains were interred with military honors."

Judah and Mary had 10 children. These children became successful farmers, livery stable owners, and fire department and steamboat captains. One daughter married a lawyer and another married the uncle of Ulysses S Grant.

Judah, a young, petty criminal from London, overcame his troubled, and humble beginnings to foster a new life in America, living the American dream.

Genealicej@... 12/18/00 #446329 Researching a LEVI family in Louisville, Kentucky and Portsmouth, Ohio, I keep bumping against researchers looking for the family of Mordecai and Judah LEVI, as far as I know unrelated to my own LEVI family (although I shall never say never!). Since I have recently been contacted by yet another descendant of Judah LEVI, I thought it would be useful to compose a posting, in case anybody knows anything about the English side (or any other side) of this prolific and fascinating Kentucky family. Judah LEVI (born about 1760 ?London-1829 Mason County, KY) was transported to the colonies in 1771 as a 10 year old convict who had stolen a handkerchief in London. He fought in the American Revolution, settling in Fauquier Co, VA, then Mason County, KY. Two of Judah's sons, Elias and Willis opened a livery stable in Louisville, KY by 1832 which stayed in the family until about 1890. Some of the LEVI family went to Portsmouth, Ohio. Although Jewish originally, Judah is believed to have become a Protestant and was married by Baptist minister in VA. There is a tale within the family that his brother Mordecai, a London jeweller and moneylender, who died in London about 1828, left a large unclaimed fortune ... If anyone has any information on this family, I am sure the researchers I have encountered would love to know about it and I will pass on the information. Source: S1101 Volume 30, No 3 July - September 1998 By Betty Jo Stockton Page 660 Judah Levi - From Prisoner to Patriot Betty Jo Stockton, 4th g-grandfather was Judah Levi Many of the early settlers of Virginia came seeing freedom, riches or adventure. But not all those involved in the colonial movement were willing participants. Thousands were transported to America as criminals (or real or trumped-up charges) to clear out the poor and unwanted of England and provide cheap labor for the plantations. One of these was my 4th great grandfather, Judah Levi [called in various documents: Judah, Juda, Judas, Judith, Judy, etc. Spellings of the surname included Levi, Levy, Leevy, Leavy, etc. He signed documents with an X, so the proper spelling is not known] Judah Levi was probably born in London in October, 1759, as we have records of a circumcision of Judah, son of Elias Levi, 4 Nov 1759. He would have been barely 12 years old at the time of his trial and conviction as a thief in London in December 1771. From the trial records we find that Judah and Elias Levi (brothers or cousins?) were arrested and brought to Old Bailey for trial in December 1771 for "stealing a handkerchief of the value of 10 pence, the property of Joseph Crompton, 25 Oct 1771." The accuser, Joseph Crompton, stated that "he saw the 2 prisoners come into the hall (Guildhall). The great boy was pushing to little one on; they were both at this gentleman's pocket.. When they had got the handkerchief out, they made off. I tapped the gentleman on the shoulder and we went after them. The little boy had the handkerchief in his pocket .. he said the great boy put his hand through his coat and picked the gentleman's pocket and put the handkerchief in his pocket." Elias Levi's defense: " I went on an errand for my master .. A man took this boy and he said 'Here is another Jew, we will take him with us' I am a butcher, 14 years old." Judah Levi stated, "I was on an errand for my mother and, going through the Guildhall, I trod on something. I though it was a piece of borwn paper, I took it up, it was this handkerchieff .. no one owned it, so I put it in my pocket. This man come up and laid hold of me and, seeing the other boy, he took him along with him." Judah Levi called his uncle, Henry Levi, who gave him a good character. Both boys were found guilty and sentenced to 7 years transportation. A few days later, Henry Levy was also accused of stealing a handkerchief, found guilty and sentenced to 7 years transportation. It is interesting that Peter Coldham in his book Emigrants in Chains says that the most prevalent crime for which transportation was imposed was the theft of a handkerchief. More serious crimes were punishable by hanging, rather than transportation to the colonies and those who were hung were not much use a cheap labor. All 3 were transported on the ship Justitia, to "some of his majesty's colonies or plantations in America." The ship manifest signed by Neil Gillis, master of the Justitia, on 12 Dec 1771 lists 15 convicts on board, including Judah Levy, Alias Levy and Henry Levy. The destination of the Justitia was the Rappahannock River in Virginia. Where Judah spent the next few years is not known, but he was probably sold as an indentured servant somewhere in central Virginia and served at least part of his 7 year sentence. No other information has been found on either Elias or Henry Levi. By 1777 in Fauquier VA and enlisted in VA tropps for 5 years. Private in Col Abraham Buford's Regiment of Virginia Troops. During the Battle of Waxhaws, SC on 29 May 1780 (also known as Buford's Defeat), Judah was "desperately wounded in the head, left eye and thigh." One fatality of Battle of Waxhaws was James McGraw, whose daughter Mary married Judah Levi after the war. Judah was captured and imprisoned in the British hospital for 13 months. He was discharged on parole, which he broke and then re-enlisted with the Virginia troops until the end of the ware. In his application for a pension he state he had also been with LaFayette at the Battle of Brandywine in 1777. - Medical report in 1789 state that "Judah Levi, aged 28 years, late a private in Buford's detachment and whose pay was at the rate of 24 oe per annum disabled in the service of the US by several wounds to his head and face and a wound by a bayonet through the left thigh. He is confirmed on the pension list with the annual allowance of 15 oe. - After the war, Judah returned to Fauquier County and in 1783 married Mary McGraw, daughter of James and Jemima McGraw. James McGraw had not survived the Battle of Waxhaws; Jemima, his wife, had been allotted public support as the wife of a soldier in the Continental Army. The marriage was performed by John Monroe, the Baptist minister, on 22 October, 1783. No records of land ownership have been located, but in 1792 Judy Levi leased land from Lord Fairfax, being: 72 acres - for the lifetime of Judah Levi, Mary his wife and Elias his son. A lot of land.." On this land he was required by the lease to "build a dwellinghouse 20 feet long and 16 feet wide with a brick chimney and keep the same in good and tenantable repair. And further .. raise and plant an orchard of 100 apple trees and plant the same at least 30 feet asunder and keep the same well trimmed and fenced .. and not to waste, unnecessarily destroy, or dispose of any timber growing upon the land, but only to make necessary use of the same." In about 1800, many families from Fauquier County removed to Mason County, Kentucky. Judah and Mary Levi, along with their 8 or 9 children and Mary's brothers Cowither and Isaiah McGraw and their families were among this group. Mary's oldest brother, John, had been with the first party who went with Simon Kenton to settle Mason County in 1783. Many former soldiers received free land as reward for their service in the Revolution, but the papers required for Judah Levi were apparently lost in the bureaucracy. In 1823, Col. Buford certified his service, stating that he had "many years before, put in the hands of William Marshall of Virginia, a certificate for the purpose of obtaining said Judas's military land warrant. William Marshall shortly after died, since which the certificate has not been found." As late as 1840, Judah's sons, Elias and Willis were still trying to get his bounty grant. Judah was appointed Marketmaster in Maysville, KY and was on hand to great General LaFayette when he visited in May of 1825. He owned land both in the city of Maysville and on Bracken Creek, bordering Bracken County. In the Mason court records of 1829, his name was proposed as inspector of tobacco. Some of the commissioners objected, stating that "he can neither read, write or calculate. He is intemperate and often intoxicated" he was appointed anyway. After his death on 24 June 1829, his obituary in the Maysville Eagle read "died Wednesday evening, Judas Levi, a soldier in the Revolution in his 67th year. His remains were interred with military honors." His burial place remains unknown. Mary (McGraw) Levi lived until at least 1850 and probably died in Brown Co., OH at the home of her daughter Elizabeth (Levi) Parker. The 10 children of Judah Levi became farmers, livery stable owners, fire department and steamboat captains. One daughter married a lawyer; another married that uncle of Ulysses S Grant. The convict from London had founded an American family. The known children of Judah and Mary (McGraw) Levi were: Elias Levi b. Buford refused an initial demand to surrender, but when his men were attacked by Tarleton's cavalry, many threw down their arms to surrender. Buford apparently attempted to surrender. However, the British commanding officer Tarleton was shot at during the truce, causing his horse to fall and trap him. Loyalists and British troops were outraged at the breaking of the truce in this manner and proceeded to fall on the Americans.[2][3] While Tarleton was trapped under his dead horse, the British continued killing the Continental soldiers, including soldiers who were not resisting. The British gave little quarter to the rebels. Of the 400 or so Continentals, 113 were killed with sabers, 150 so badly injured they could not be moved, and the British and Loyalists took 53 prisoners. "Tarleton's quarter" thereafter meant refusing to take prisoners. In subsequent battles in the Carolinas, it became rare for either side to take significant prisoners. The Battle of Waxhaws became the subject of an intensive propaganda campaign by the Continental Army to bolster recruitment and incite resentment against the British. After Lord Cornwallis surrendered at Yorktown, the only British officer not invited to dine with General Washington was Tarleton. Background Main article: Southern theater of the American Revolutionary War Following the British defeat at Saratoga in 1777 and French entry into the American Revolutionary War in early 1778, the British military decided to embark on a "southern strategy" to win back their rebellious colonies. The British believed they had more supporters in the South due to the close business and trading relationships, and that they might concentrate power in the South and later retake the North. They began the campaign in December 1778 with the capture of Savannah, Georgia. In 1780, General Sir Henry Clinton brought an army south and captured Charleston, South Carolina on May 12, 1780, after a siege.[4] Prelude Colonel Abraham Buford commanded a force of about 380 Virginian Continentals (the 3rd Virginia Detachment, composed of the 7th Virginia Regiment, two companies of the 2nd Virginia Regiment and an artillery detachment with two six-pounders).[1] Most of his men were raw recruits with little battle experience, although Buford had experienced officers under his command. Because of delays in outfitting his command, Buford had been unable to reach Charleston and participate in its defense.[5] Charleston's commander, General Benjamin Lincoln, had ordered him to take a defensive position near Lenud's Ferry on the Santee River outside the city, but Lincoln surrendered around the time Buford reached this position. Buford was eventually joined by about 40 Virginia Light Dragoons who had escaped the siege or during battles outside the city, and by Richard Caswell's North Carolina militia. Receiving news of the surrender, Buford was ordered by General Isaac Huger to return to Hillsborough, North Carolina. He turned his column around and headed north.[1][6] At Camden, Buford and Caswell parted ways, with Buford marching north into the Waxhaws region. Buford was accompanied for a time by South Carolina Governor John Rutledge, who had been actively recruiting militia in the backcountry. When Buford stopped to rest his troops at Waxhaw Creek, Rutledge rode ahead toward Charlotte, North Carolina.[7] General Clinton learned of Huger's and Rutledge's forces and on May 15 ordered Lord Cornwallis to bring the South Carolina and Georgia backcountry under British control.[5] His army moving too slowly to keep up with Buford, Cornwallis on May 27 sent Lieutenant Colonel Banastre Tarleton in pursuit with a force of about 270 men. Tarleton commanded the British Legion, a primarily Loyalist provincial regiment. The force he took in pursuit of Buford consisted of 170 Legion and British Army dragoons, 100 mounted British Legion infantry, and a three-pounder cannon.[1][7] Tarleton reached Camden late on May 28, and set off in pursuit of Buford around midnight early the next day.[7] By that afternoon, his advance force of 60 dragoons from the 17th Light Dragoons and the British Legion cavalry, 60 mounted infantry from the British Legion, and an additional flanking force of 30 British Legion dragoons and some infantry, had reached Buford's resting place. Warned of Tarleton's pursuit, Buford had begun moving north, and was 2 miles (3.2 km) up the road. Battle Tarleton sent Captain David Kinlock forward to the rebel column, carrying a white flag, to demand Buford's surrender. Upon his arrival, Buford halted his march and formed a battle line while the parley took place. Tarleton greatly exaggerated the size of his force in his message—claiming he had 700 men—hoping to sway Buford's decision. The note also said, "Resistance being vain, to prevent the effusion of human blood, I make offers which can never be repeated", indicating that Tarleton would ask only once for Buford to surrender. Buford refused to surrender, responding: "I reject your proposals, and shall defend myself to the last extremity."[8] Buford reformed his troops into a column, and continued the northward march, with his baggage train near the front of the column. Tarleton, in violation of accepted rules of war, had continued his march while the parley took place.[8] Lieutenant-Colonel Banastre Tarleton by Joshua Reynolds Around 3:00 pm the leading edge of Tarleton's force caught up with Buford's rear guard. According to a Patriot eyewitness, a field surgeon named Robert Brownfield, the five dragoons of the rear guard were captured, and their leader, Captain Pearson, was "inhumanely mangled" by saber cuts, some inflicted after he had fallen.[8] Buford stopped the column (except for the artillery and the baggage, which he ordered to continue on), and formed a single battle line near some open woods.[9][10] Tarleton, some of whose horses were so tired from the pursuit that he was unable to bring his field artillery into range, established a command post on a nearby hill, and organized his forces for the attack. According to his account of the battle, he arrayed 60 British Legion dragoons and a like number of infantry on the right, the dragoons of the 17th along with some additional British Legion dragoons in the center, and he personally took command of the left, commanding "thirty chosen horse and some infantry".[9] Stragglers were to form a reserve corps atop the hill.[9] What happened next is the subject of much debate; there are significant inconsistencies in the primary accounts. Tarleton's line charged, and Buford waited until the enemy was within 10 yards (9 m) before giving the order to fire.[9] This was a tactical mistake on Buford's part, for it enabled Tarleton's formations to hold, while giving Buford's men time to fire only a single volley before the British riders were attacking the line.[11] As Tarleton's cavalry tore Buford's line to pieces, many of the Americans began laying down their arms and offering to surrender. According to Patriot accounts, Buford, realizing the cause was lost, dispatched a white flag toward Tarleton in an attempt to surrender (exactly when differs among the accounts). However, Tarleton was trapped beneath his dead horse, following the mount being shot from under him during the surrender, and may never have received it. Although Patriot accounts say that a surrender flag was sent, they differ both on who carried it, and how its messenger was treated. Loyalists and British troops were incensed at the betrayal and fighting continued on both sides despite the white flag being visible. The conflicting Patriot accounts agree that flag was effectively refused. None of the British accounts of the battle mention the surrender flag. Buford and some of his cavalry were able to escape the battlefield.[12] According to Tarleton's report of the battle, the American rebel casualties were 113 men killed, 147 wounded and released on parole, and 2 six pounders and 26 wagons captured. The British losses were 5 killed, 12 wounded, with 11 horses killed and 19 horses wounded. Tarleton's men had also recovered the American baggage train. Historians in the 19th century blamed Tarleton for the massacre, but most contemporary references to it do not describe it as such.[13] Tarleton, in a version published in 1781, said that the battle was a "slaughter"; he said that his horse had been shot from under him during the initial charge and his men, thinking him dead, engaged in "a vindictive asperity not easily restrained".[14] William Moultrie noted that the lopsided casualty count was not unusual for similar battles in which one side gained a decided advantage early in a battle. Historian Jim Piecuch argues that the battle was no more a massacre than similar events led by Patriot commanders.[15] David Wilson, on the other hand, holds Tarleton responsible for the slaughter. He notes that it represented a loss of discipline, something for which Tarleton was accountable. He had already been reprimanded for transgressions by his men at the Battle of Monck's Corner in April. When they learned of what had happened, albeit one-sidedly, news of the apparent violation of quarter on Tarleton's part spread rapidly through the region.[18] Monument and mass grave at the battle site The battle, at least temporarily, consolidated British control over South Carolina, and Patriot sentiment was at a low ebb. General Clinton, among other acts before he left Charleston for New York, revoked the parole of surrendered Patriots. This affront (violating accepted "rules of war"[citation needed]), and reports of this battle, may have changed the direction of the war in the South. Many who might have stayed neutral flocked to the Patriots, and "Tarleton's Quarter!" and "Remember Buford" became rallying cries for the Whigs. News of the massacre directly inspired the creation of volunteer militia forces among the over-mountain men (from the Wataugan settlements at, and near Sycamore Shoals). These militia participated in actions against British Loyalists at both the Battle of Musgrove Mill on August 18, 1780, (near present-day Clinton, South Carolina) and in the decisive defeat of British Major Patrick Ferguson's command on October 7, 1780, at Kings Mountain (near present-day Blacksburg, South Carolina). He would have then marched to South Carolina with Buford, where they missed the battle of Lenud's Ferry by being on the wrong side of the river. He would have then been in the battle of Waxhaw, where 500 of Buford's 530 men were killed by the British after a mistaken surrender attempt. Given these facts, it is most likely that Francis was killed in this Battle of Waxhaw on 29 May 1780. If however, Francis survived Waxhaw, he would have marched north to Yorktown, where Buford commanded and won the seige of Yorktown. While it was the custom to call unrelated men of the same name by Jr. and Sr., I feel that geographical considerations and the surrounding evidence support the conculsion that William and Francis are brothers, and sons of William Sr. There is no further reference to Francis in Spots Co Va records. Record Series: Biography of Valentine Peers Valentine Peers was born in Sisburn, Antrim County, Ireland in 1756 and emigrated to North America in 1773. He entered the Revolutionary Army of Virginia in 1776 and served as a brigade major under the command of General George Weedon. He served in the Battle of Brandywine, September 11, 1777, and he and his men were commended in the published orders of General George Washington and Major General Nathaniel Greene (see Saffell's Records of the Revolutionary War, pp. 339-343). Valentine Peers was released from service November 19, 1777 as noted in a letter from General Weedon (Box 1, Folder 3, Item 2). He was granted 5,333 1/3 acres in compensation for commendable military service. Peers then settled in Loudoun County, Virginia but later moved his family to Mason County, Kentucky, where he was among the area's earliest settlers. Unlike most, who voluntarily emmigrated seeking religious freedom or adventure, Judah, at the tender age of 12, was banished to the colonies as a convicted criminal for 'stealing a 10 pence handkerchief'. Judah Levi, son of Elias Levi, was born in London in October 1759. In 1771, at the Old Bailey criminal court in London, young Judah and an older relation, Elias Levi, were tried and convicted of theft and sentenced to 7 years transportation and labor in the British colonies. Later young Judah's uncle, Henry Levi, is also implicated in the crime and similarly charged, convicted, and sentenced. All three are then found aboard the ship Justitia bound for the Rappahannock River in Virginia. Between 1771 and 1777 Judah's whereabouts and history are unclear but in 1777 in Fauquier, Virginia Judah is found enlisted for 5 years in Colonel Abraham Buford's Regiment of Virginia Troops. During his enlistment, Judah is one of the few surviving Whigs from the Battle of Waxhaw that occurred in South Carolina on 29 May 1780. This revolutionary battle, known as 'Buford's Defeat', was a decisive win for the British and was described as a 'massacre' due to the bloody manner in which the Loyalists killed and maimed their opponents. Judah survived this battle but was "desperately wounded in the head, left eye and thigh" and spent over a year as a British prisoner recovering from his wounds. On his parole, Judah returned to Virginia and re-enlisted until the end of the war. It is said he engaged in the Battle of Brandywine in 1777 under Lafayette's command. After achieving independence, Judah returned to Fauquier County and married Mary McGraw, daughter of James and Jemima McGraw. His wife's father, James McGraw, also fought in the Battle of Waxhaw but had not survived. Judah and Mary's marriage was performed by John Monroe, a Baptist minister, on 22 October 1783. In 1792 Judy Levi is living on leased land from Lord Fairfax: '72 acres - for the lifetime of Judah Levi, Mary his wife and son Elias'. The lease requirements are to "build a dwellinghouse 20 feet long and 16 feet wide with a brick chimney and keep the same in good and tenantable repair. And further .. raise and plant an orchard of 100 apple trees and plant the same at least 30 feet asunder and keep the same well trimmed and fenced .. and not to waste, unnecessarily destroy, or dispose of any timber growing upon the land, but only to make necessary use of the same." In about 1800, the Levi and McGraw families remove from Fauquier County, Virginia to Mason County, Kentucky. This group included Judah and Mary's family with 8 or 9 children and his brother-in-law's families, Cowither, Isaiah, and John McGraw. During this time Judah Levi applied for military bounty land benefits but his initial attempt failed. A subsequent application for bounty land benefits was presented again in 1823, with Colonel Buford certifying that Judah had "many years before, put in the hands of William Marshall of Virginia, a certificate for the purpose of obtaining said Judas's military land warrant. William Marshall shortly after died, since which the certificate has not been found." This second application also fails. Subsequent other attempts to secure bounty land by Judah and his sons, Elias and Willis, continue into the 1840s. Judah was appointed Marketmaster in Maysville and later Tobacco Inspector. Judah was on hand to greet General LaFayette when he visited Maysville in May of 1825. He owned land both in the city of Maysville and on Bracken Creek, bordering Bracken County. Judah died on 24 June 1829, his obituary in the Maysville Eagle read "died Wednesday evening, Judas Levi, a soldier in the Revolution in his 67th year. His remains were interred with military honors." Judah and Mary had 10 children. These children became successful farmers, livery stable owners, and fire department and steamboat captains. One daughter married a lawyer and another married the uncle of Ulysses S Grant. Judah, a young convict from London, overcame his troublesome, humble beginnings and fostered the American dream.
