Biography

In the Name of god amen, I Joseph Matthias Senior of Frederick County in the State of Maryland being weak in body but of sound and disposing mind memory and understanding considering the certainty of death and the uncertainly of the time thereof and being desirous to settle my worldly affairs and thereby be the better prepared to leave this world when it shall please god to call me hence do therefore make and publish this my last will and testament in manner and form following that is to say -- First and principally I commit my soul into the hands of the almighty god and my body to be decently buried at the discretion of my Executors herein after name and after my debts and funeral charges are paid I devise and bequest as follows – Item I give and devise unto my son Joseph Matthias Junior his heirs and assigns forever all the parts or parcels of land composing the plantation whereon I at present dwell computed to contain two hundred eight acres of land with the improvements of every description thereon. Item I give and devise unto my son Joseph Matthias Jr his heirs and assigns forever all that part of parcel of land lying and being in Frederik County being part of a tract of land called “Ohio” containing twenty eight acres and is the same land that was conveyed to me by Samuel Owings by Deed bearing the date the 15th day of September 1791. Item I give and bequeath unto my son Joseph Matthias Junior and his heirs my German family Bible. Item I give and bequeath unto my son Joseph Matthias Jr and his heirs my new waggon, three head of horses and the harness and gears belonging to them. Also two cows and one sheep. Item I give and bequeath unto my son Joseph Matthias Junior my bureau and desk It is my will and I do hereby direct that what personal property shall appear to be remaining after me and my wifes decease (except that personal property which I had this day valued by John Wampler and Adam Bish and my son Joseph Matthias Jr agreed to take the same at their valuation) to be sold at public sale by executors and the proceeds thereof to be equally divided by them amongst my daughters and their heirs. It is my will and I do hereby direct that the amount of all obligations and sums of money that shall appear to be in the possession of myself and wife after our decease to be equally distributed between my daughters and their heirs by my executors. I do hereby empower and authorize my executors herein after named or either of them or the survivor of them to execute and acknowledge any deed or deeds of whatsoever nature or kind to the purchaser or purchasers of any lands that I have heretofore sold and which shall hereafter appear to be not sufficiently conveyed by me. And lastly I do hereby constitute and appoint my son George Matthias and John Wampler to be the sole executors of this my last will and testament revoking and annulling all former wills by me made heretofore ratifying and confirming this and none other to be my last will and testament. In Testimony whereof I have here unto set my hand and affixed my seal this sixteenth day of October in this year of our Lord eighteen hundred and ten. Signed sealed published and declared by Joseph Matthias Senior the above testator named as and for his last will and testament on the presence of us who at his request in his presence and in the presence of each other have subscribed our names as witnesses thereto -- [Peter Bixler?] [Frederick?] Bachman Junior Benjamin Bixler John Wampler Frederick County to wit on the 26th day of April 1811 then came George Matthias and made oath on the holy Evangels of Almighty God that the foregoing instrument of writing is the true whole will and testament of Joseph Matthias Sr, late of Frederick Conty deceased that hath come to his hands and possession and that he doth not know of any other -- Rich. Butler Registrar Frederick County to wit on the 26th day of April 1811 then came Peter Bixler, Frederick Bachman Jr and Benjamin Bixler, three of the subscribing witnesses to the foregoing last will and testament of Joseph Matthias Senior last of Frederick County deceased and made oath on the holy Evangels of Almighty God that they did see the testator therein named sign and seal this will that they heard him publish pronounce and declare the same to be the best of their apprehensions of a sound and disposing mind memory and understanding that they respectively subscribed their names as witnesses in the presence and at the request of the testator and that they did also see John Wampler the other subscribing witness sign his name as a witness to said will in the presence and at the request of the testator and all in the presence of each other -- Rich. Butler Registrar Frederick County tow wit on the 21st day of August 1811 then came John Wampler and made oath on the holy Evangels of Almighty God that the foregoing instrument of writing is the true whole will and testament of Joseph Matthias Senior, late of Frederick County deceased that has come to his hands and possession and that he doth not know of any other.
