Co 1823, Nathan Henry vs. Abel Newbraugh } Case Monongalia County Courts Memorandum that on the 25th day of August in the year 1823 Jacob Scott of said county personally personally appeared before me a justice of the peace for said county an undertook for Abel Newbrough At the suit of Nathan Henry in an action on the case now defending in the county court of Monongalia county that in cast the said Abel Newbrough shall be cast in the said suit He the said Abel Newbrough will pay and satisfy the consideration of the court, as render his body to prison in execution, for the same, or that he the said Jacob Scott Will do it for him. Given under my hand on this 25th day of August in the year 1823, John Cox Know all men by these presents, That we Abel Newbrough and Morris Newbrough are held and firmly bound unto John S. Barns, sheriff of Monongalia county, in the just and full sum of $200 to be paid unto the said John S. Barns, his heirs, executors, and administrators or assigns to the true payment of which we bind ourselves. Our heirs, executors and administrators, justly and severally and firmly by these present sealed with our seals and dated this 14th day of July in the year 1823 The condition of the above obligation is such. That whereas Nathan Henry hath sued out of the County court he holden at Morgantown, Monongalia court house, a writ of Capias ad respondendum, against the body of the above bound (capias warrant is essentially an order to arrest and detain an individual for the purpose of guaranteeing a court appearance.) Abel Newbrough for the plea of trespass on the case (trespass on the case is an action brought to recover damages from a person whose actions have resulted indirectly in injury or loss.) Damage, $75 writ hath been duly executed by me David M. Hope deputy sheriff for John S. Barns sheriff of the county aforesaid, now it the above bound Abel do and shall well and truly make his appearance according to law before the Justices of County court on the 4th Monday in August next Then an There to answer the said suit, and do not, depart from thence without leave of the said court, or be discharged by due course of law, then the above obligation to be void, else to be and remain in full force and virtue, signed, sealed and delivered ) Abel Newbrough In the presence of Maurice Newbraugh Nathan Henry by case Abel Newbrough, 1823 Oct. To appear before the justices of our county court of Monongalia at the court house of Monongalia, at the court house of the said county on the 3rd day of Nov. term next. To testify and the truth to speak on behalf of Nathan Henry in a certain matter of controversy before our said court Depending and undetermined, between said Nathan Deft. & Abel Newbrough, Defs. And this they shall in no wise omit under the penalty of 333 1-3 dollars each and have then there then writ; Witness Nimrod Evans. Clerk of this said court, at the court house aforesaid, the 10th day of Nov. 1823 an 48 year of the Commonwealth

Record 298-A County Court 1823 Nathan Henry vs Abel Newbraugh Monongalia County Courts Nathan Henry complaius of Abel Newbrough in custody a plea of trespass on the case for what whereas the said Plaintiff have to fore towit on the 1st day of May 1823 at the County aforesaid at the affidavit and request of the said defendant bargained in the said defendant to exchange with him the said defendant a mare of him the said (together with the sum of $5.00) plaintiff for a horse of him the said defendant & the said defendant by item and there falsely and fraudulently warranting the said horse Of him the said defendant to be sound in every respect then and there executed his obligation to the said defendant and also delivered this said mare to the said defendant and in fact the said horse was at the time of the said warranty & exchange Unsound and deficient in his eye sight so as to be of but little value and hath from thence ? in fact ? that the said defendant by means of the premises on the day and year aforesaid at eh county aforesaid falsely and fraudulently decreed his the said Plaintiff on the ? exchange foresaid whereby he is greatly required and hath suppled f? Exchange to the value of $75 And whereas also the said Plaintiff on the same day and year aforesaid was lawfully ? of a certain mare of the value of 75 dollars and where as also the said Plaintiff on the same day and year aforesaid was lawfully profited of or certain mare of the valve of Env. 298a, County Court, Monon. Co. 1823 Nathan Henry vs Abel Newbraugh case $75 as of his own property and being no profited be the said defendant Casually lost the same out of his procession and item came after is and is to:wit or this same day and year last, aforesaid came to the procession of the said defendant by findlng yet the said defendant will knowing the said mare to be the property of the said Plaintiff and of right to belong & appertain to him but containing and fraudulently intentionally to injure the said Plaintiff in this behalf Hath not although often requested so to delivered the said mare to the said Plaintiff but hath neither to wholly neglected and refused is to sold and afterwards to wit on the same day and year last aforesaid convened & disposed thereof to his own use to the damage of the said Plaintiff 75 dollars & therefore of he brings said
