James Baskerville: I am a woodsman residing at White Horse Flat, Inglewood. I have seen the remains of the man now lying dead at the Shamrock Hotel, Inglewood. The remains are those of Daniel Fisher Paul. The deceased was my mate on the eleventh at about nine of the clock. The deceased and I were felling a tree about five miles from Inglewood with axes. The deceased was at the side of the tree and I was at the opposite side. The deceased and I ceased cutting because the tree appeared to be falling. The deceased called out Which way. I said on your side. The deceased ran and the tree falling caught the deceased in its branches. I went to the deceased who was lying on the ground. I carried the deceased and blood was coming from his mouth and nose. The deceased said my tongue, my tongue. The deceased did not live three minutes after I carried the deceased from the ground.
