On 17 April 1793, Moody's father sold to his son four parcels of land in Sutton, Massachusetts, comprising a total of 158 acres of land and buildings thereon, for £550. This deed is recorded in the Worcester County Deed Books. On the same day, Moody "sold" the land back to his father for the same amount of money, with a long list of conditions attached to this second deed, which was not entered into the formal deed books.
This document, entitled Moody Severy's Mortgage Deed to his Father, outlines an understanding that, providing Moody fulfilled all the conditions therein, he would inherit the land after his father's death.
These conditions included allowing his parents to live on the property, providing them with produce, a share of the profits and firewood, allowing his unmarried sisters to also live on the property with similar provisos after the death of his parents, and a series of legacies to be paid to Moody's brothers and sisters after his father's decease.
Jacob, Moody's father did not leave a will when he died in 1826, and so this document can be seen to be acting in its stead as a "living will" might do today.
