I Thomas Waller of the county of Mason and the Commonwealth of Kentucky do hereby make and ordain this instrument as my last will and testament hereby revoking all other will or wills by me made and acknowledging this only. First, I give and bequeath to my son Richard Waller one dollar, also to my daughters Sophia Ragsdale Threlkeld, Polly Threlkeld, Elizabeth Small, Ann Barns and Eleanor Small, one dollar each to be paid to them in Cash on demand by my executors hereafter named, Secondly I give and bequeath to my son Cornelius Waller, one half of the tract of land, or one hundred and four acres to be laid off to him, on the upper or South end of my tract where I now live, to include [the farm/strike out] his present dwelling house and farm. Thirdly, I give and bequeath to my son John Waller the other half of my tract or one hundred and four acres to be laid off to him on the lower or North end of said tract where I now live (with a reserve of my present dwelling house and one half the nett [proceeds/strikeout] profits of the farm and firewood for the use of my wife Sophia Waller during her life) and to be managed and directed by my said son John Waller and to be fully his after her decease. Fourthly it is my will the money arising from the sale of my present crop of wheat, as well as the money now on hand or that is due to me shall be appropriated to the payment of my debts, first to Pogue and Bodley and then to my other debts (except about one hundred dollars that my son Cornelius Waller is to pay said Pogue and Bodley out of his private funds) - Fifthly, I give and bequeath to my Grand daughter Ann Threlkeld one horse, bridle and saddle worth [seventy five/strike out] sixty dollars, also one Bureau worth twenty-five dollars and also one bed and furniture worth thirty dollars to be paid to her by my executors on demand after my decease. Sixthly, I Direct that all the balance of my personal estate and slaves shall be appraised by order of the County Court of Mason and left in possession of my wife Sophia Waller, and for her use during her life, and after her decease to be sold on a reasonable credit, and the proceeds of such sale to be equally divided between my aforesaid daughters Sophia, Ann, Polly, Elizabeth, Anna and Eleanor (or in case of any of their deaths to their children. and further I do constitute and appoint my wife Sophia Waller, and my sons Cornelius and John Waller, as my executors of this my last will and testament. Given under my hand and seal this sixth day of February eighteen hundred and seventeen.
