Will of Marcy Wood Emerson, widow of John Emerson

In the name of God, Amen. The 15th day of April, AD 1795, the 19th year of our independence.

I, Marcy Emerson of Douglas, in the County of Worcester and Commonwealth of Massachusetts, widow. Being of sound mind and memory thanks to God, desirious to settle what worldly state the Lord has lent me, I ordain this my last will and testament hereby revoking all other wills of mine of this nature made by me heretofore in word or writing.

First I constitute my eldest son, Joseph Emerson, sole executor of this, my last will and testament.

I commend my soul into the hands of God, my Creator and Redeemer, and my body to the Earth to be decently buried at the discretion of my Executor. I will that my Executor pay all my just debts and funeral charges out of my estate within one year after my death. And also the following legacies.

I bequeath to my eldest son, Joseph Emerson (or his heirs) one hundred and fifty dollars.

Next I bequeath to Ezekiel Emerson, my youngest son (or his heirs) sixty dollars.

And to my daughter Ruth, the wife of Abner Yates, (or her heirs) Fifty dollars.

And to my youngest daughter Katherine, the wife of Joseph Fairbanks, (or her heirs) I give fifty dollars.

Like wise to Nancy, oldest daughter of my son Ezekiel Emerson, (or her heirs) I give my gold necklace.

And if anything remains after this apportionment, I will that it be divided equally between my two sons and daughters mentioned above.

This is a just and equal distribution of my estate; to each their full portion with what they have already had of their father, John Emerson's and mine estate.

In witness whereof I have here unto for my heirs and sealed the day and year above mentioned.

Signed sealed and pronounced by the said Marcy Emerson to be her last will and testament in (something) of us Susanna Stone Moses Stone Isaac Stone

Douglas July 1801 Whereas there is a probability of the heirs settling, I therefore decline accepting the trust as Executor to the Will mentioned at present. signed Joseph Emerson

Wood-26483 and Wood-15675 appear to represent the same person because: the two women have similar names ("Mercy" is a derivative of "Mary"), similar marriage dates to the same spouse and the same death dates.
