James died on 18 August 1834. Isabella died the prior year on 19 September 1833.
On 18 September 1834 in Smyth County Court, the Last Will & Testament of James Gillespie, deceased, was proved in Court by the oaths of Soloman McDanald, Joseph Sexton, and Thomas Sexton, witnesses thereof and was ordered to be recorded. Thomas R. Gillespie, Soloman McDanald, and Joseph Sexton entered a bond of $6.00, and Thomas R. Gillespie was granted certificate of probate. Robert Gillaspey was apparently not at the Court, as the order states "liberty being reserved to the other Executor named in the said will to join in the probat when he shall think fit."[5] The Court ordered Andrew H. Law, John G. Sexton, Issac Patrick, and Robert Buchanan, or any three of them, to appraise the estate.
On 18 December 1834 in Smyth County Court, Andrew H. Law, John G. Sexton, and Issac Patrick returned the appraisement and it was ordered to be recorded.[6]

This new James is either a "new" member of the Gillespies of Cowpasture River, or his land record suggests one of the existing James' profiles has a birth date that is too late (e.g. this James Gillespie).
so fun!!!!
