On 25 March 1873 Sarah Rhodes joined her sisters in bringing a complaint against her uncle, Dickerson Nailor, in Washington, District of Columbia, USA. The lawsuit complained that Nailor had withheld the proceeds from the estate of their late sister, Margaret Grimes. Nailor had been the Executor of her will and the sisters wanted him to distribute their shares.[4] The petition stated:
"To the Honorable the Judges of the Supreme Court of the District of Columbia holding a Probate Court for said District. The petition of Mary S. Cohill, Cinderella Grimes, and Sarah Rhodes respectfully showeth unto your honor that on or about the 25th day of Nov. 1868 Margaret C. Grimes died leaving a will dated 16th Nov 1868 and in said will appointed one Dickerson Nailor her sole Executor. Your petitioners further represent that they are sisters of the said Margaret C. Grimes, deceased, and sole beneficiaries under the said will, and that the estate of the said deceased is bequeathed to them in equal proportions after the payment of certain expenses therein specified. Your petitioners further represent that the said Dickerson Nailor qualified [?] as Executor of the said estate on the 5th day of December 1868, and gave bond to faithfully discharge the duties of the trust and in pursuance of the authority so derived took possession of the goods, chattels, and monies, and other effects of the said deceased, amounting in all to the sum of ,000 more or less. Your petitioners further represent that the said Dickerson Nailor has failed to make any return or report to this court or to pay to these petitioners any portion of the estate so bequeathed. Your petitioners therefore pray that an order may issue out of and under the hand and seal of this honorable court directed to the said Dickerson Nailor commanding him at an early day ...[illeg] ... to appear before your honor and show cause if any he has why he shall not state an account and report to this court the manner in which he has performed his trust, and for such action and further relief as to your honor may sense just and proper and your petitioners will ever pray, etc. by L.M Saunders, Atty for Petitioners."
