James Hicks was born about 1695 in Virginia. He died in 1761 in Brunswick County, Virginia.[1]

James married (1) Martha, (2) Fathy (named in will).

1744 Jun 1 - Indenture made the 1st day of June, 1744, between James Hick and Benjamin Seawell, for 16 pounds, conveying 200 acres on North side of the Great Branch at James Wyches path. Witnesses were John Wall, Jr., George Hicks, and Henry Beddingfield. Acknowledged in Court on June 7, 1744, at which time Martha Hicks, wife of the said James Hicks, appeared and relinquished her dower.[4]

1744 Jun 5 - Indenture made the 5th day of June, 1744, between James Hicks of Brunswick County, and George Hicks of Brunswick County, Gent., for 150 pounds, conveying 810 acres on North side of Maherrin River, being the plantation whereon Capt. Robert Hicks formerly lived and part of the 1,010 acre of land devised by the Last Will and Testament of Robert Hicks to the said James Hicks. Witnesses were Benjamin Chapman Donaldson, John Wall, Jr., and Henry Beddingfield. Acknowledged in Court on June 7, 1744, at which time, Martha Hicks, wife of the said James Hicks, appeared and relinquished her dower.[5]

12 February 1760

Following abstracted from the transcription of his will from Will Book 3, page 352, Brunswick County, Virginia, posted by Rebecca Maloney.[3]

"... I James Hicks of the County of Brunswick being very sick and weak but of sound mind and Memory..."
  • wife named: "Fathy Hicks"
  • sons not yet 21: "James, Lewis and John Hix be paid by my Wife or Two Executors as soon as they shall come to the Age of Twenty one years"
  • children: "Benjamin, Robert, Mary, Patty, James, Lewis, Frances and John Hicks"

Executors: "my beloved Wife, Benjamin Hix and Robert Hix Sole Executors of this my last will and Testament... signed James Hicks, and witnessed by John Stephens Junr., Henry Vinson, and Thos. Harris Williams.

"At a Court held for Brunswick County the 23rd Day of February 1761 This Will was proved According to Law by the Oaths of John Stephens Junr. and Thomas Harris Williams Witnesses thereto and Ordered to be Recorded and on the motion of Benjamin Hix and Robert Hix two of the Executors threin named who made Oath thereto and together with James Hicks and Robert Stark their Securities entered into and Acknowledged their Bond in the penalty of Three Thousand pounds Conditioned as the law directs Certificate was granted them for obtaining probate in due form."

Hi US Southern Colonies Project! I've added the project as manager of this profile. It is currently in a pending merge with Hicks-13909. I did not adopt that profile & complete the merge because Cynthia was active earlier this month (although I did not hear back from her in response to any of my posts).

I lean toward Hix for his LNAB, based on the will, but will leave it to others to decide. The merge should receive default approval in just a week or so more (it was proposed 6 March).

This has gone well past 6 March. Either merge him or not but keeping my relative "protected" goes against the spirit of Wikitree being a collaborative experience.

Patricia - because I had to wait 30 days default in order to complete the merge, it was just completed. Because of the issues that had to be addressed to sort out the MANY profiles for several men of the same name, this profile remained a project-protected profile even after the merge was completed.

Please correct these:

At the top of the profile: "James Hicks was born about 1695 in Virginia. He died in 1761 in Brunswick County, Virginia.[1]" and at the bottom of the profile: "James was born in 1708. He passed away in 1760."

update - I've not heard back from either Conan or Cynthia (Profile Manager of Hicks-13909). I've removed Conan as a manager of this profile, as he has been inactive since May 2019.

update - merges completed

Hix-319 and Hicks-13909 appear to represent the same person because: please merge. these profiles both represent the James, son of Captain Robert Hicks-3762 and his wife second wife, Frances (unknown).

The Hicks-3762 profile is attached as son of Frances House-5824, but I don't see support for giving her that maiden name. Should that profile be cut loose when the merged profile for James is attached to his father (Hicks-3762) or merged into Frances Unknown-538539? (If I missed the support for House, please point it out!)

I don't have a strong opinion as to whether the LNAB should be Hix or Hicks (the transcription of his will is mostly Hix, but it does not seem that the family at this time paid much mind to the spelling - or at least James didn't).

After the merge, next up will be his wife -> wives (from what I can tell, the maiden name of his wife Martha - named in 1740s land records - is not known & the Fathey comes from the given name of his wife in his 1761 will - Fathy Hicks (see http://www.usgenwebsites.org/vagenweb/brunswick/court/wills/hicksjames1761.html ... the more I read it, the more I think that none of the children named in the will are hers). But I digress. For now, please merge Hix-319 and Hicks-13909 and let me know if you have support for his mother's maiden name.

Hi Cynthia! It's been a couple of weeks. I'd like to get the merge of the two James Hicks/Hix profiles completed. Please approve the proposed merge, or let me know if/why you think they're not the same person. Also, let me know if you have a preference for Hicks or Hix. If you could approve the merge sooner rather than later, that would be great.

update - I've detached him from Robert Hicks-1262 and proposed a merge with Hicks-13909

the Robert he's attached to (Hicks-1262) has a note on the profile that says it's a different line ... "This line of Hicks is in no way related to the Hicks of Surry County Virginia."

Brunswick/Surry/Sussex line is Capt Robert Hicks... I'm fairly certain this James is his son (and duplicate of Hicks-13909).
