I was arrested for shooting Sergeant Smith - don't know his full name - and on his death-bed he told them I shot him accidentally - but I had been arrested and was in confinement six months before I was released. Now that was what I was arrested for. Yes, sir, I hung that thief because I was directed to do so by my superior officer who was in charge of the squad when we captured him. I have forgotten that officer's name - he was of the 38 U.S. Inf[antry].
Q: Did you ever desert from Co. C, 10 U.S. Cav.?
A: No, sir. You say the War Department record of my reg[imen]t shows I deserted. Well, I did go away awhile. Me and Sergeant Garnett could not get along together. He said he would shoot me. I told him I would leave and I did and then I was arrested.

sergeant ever once in awhile and some times I acted as officer of the day. Well, I mean by that that of going around - looking around to see if the enemy was approaching and bringing in reports or something that way.
Q[uestion]: For what were you arrested while in Co. C, 10 U.S. Cav[alry]?
A[nswer]: I never was arrested. Yes, I was too. A horse thief took a Government mule once in Kansas and I had charge of a squad (see [TBD]) to catch that thief and I caught him after a chase from seven o'clock in the morning to Eight at night, and he was shot by me. Now, I see what you are after. I was not arrested for this.
