said Marshall set forth facts as evidence which were and are false and fraudulent and, if true, were and are very material as evidence towards securing allowance of pension, to which end said Marshall fraudulently manufactured and filed same. Said affidavit makes said Jesse Hays and King Sanders falsely swear that they knew William Gibson alias John Sanders, before the war of 1861-1865, at Hanover, Jefferson Co., Indiana, when, in fact, William Gibson alias John Sanders never was at Hanover, Ind, until in 1865 sometime; when, in fact, King Sanders never was at Hanover, Ind., previous to 1870; when, in fact, King Sanders never knew or knew of Wm Gibson alias John Sanders, previous to about 1871..1872; when, in fact, Jesse Hays never knew said Gibson alias Sanders until sometime in 1865. Said affidavit makes each Jesse Hays and King Sanders falsely swear that each knew, from personal knowledge, that said Gibson alias Sanders served in Co. D, 54" Mass. Vol. Inf., under the name of William Gibson, when, in fact, Hays did not know said Gibson alias Sanders until quite awhile after said service and King Sanders did not know him till 1871 o 1872. Said affidavit makes King Sanders swear falsely that he knew said Gibson alias Sanders to serve in Co. C, 10 U.S. Cav., and to all of this false evidence said Marshall makes said witnesses appear as having personal knowledge of those
