James Levi Tate was the seventh child of 13 children born to William Tate (1748-1814) and Elisheba Hudson (1752-1833), both of whom were born in Trinity Parish, Louisa County, Virginia.

Tate married Maria Sophia Verdel (1791-1856) on January 14, 1813, in Elbert County, Georgia. They were the parents of ten children: Son Tate (1813-1813), Mary Frances Tate Pittman (1814- ), Sophia Elizabeth Tate Dickerson (1815-1855), Martha Mayfield Tate Haynes (1816-1862), Daughter Tate (1818-1818), Sarah Elizabeth Tate Spier (1819-1892), James Tate (1822- ), Enos Minor Tate (1824- ), Zimouar Thomas Tate (1825-1890), and Linire Tate (1827- ).

The 1850 U.S. Census lists Tate as a farmer worth $2,000, but the 1860 U.S. Census lists him as a gentleman worth $10,000. Today's $100 was worth $2,152 in 1860, so by the the outbreak of the American Civil War, he was doing well.
