Biography

Samuel was born in 1761. He was the son of William Caldwell and Jean Smiley. He passed away in 1811.

Last Will and testament

Will of Samuel Caldwell, deceased

In the name of God Amen, I Samuel Caldwell, Farmer of Hopewell Township, Washington County & State of Pennsylvania being sick and weak in body; but of sound memory and judgment, calling to mind my mortality, do by this my last will Testament dispose of the worldly goods with which God has been pleased to endow me, in the manner following Viz.

First, I direct that after my discease my body shall be buried in a decent and Christian like manner at the discretion of my Executor, and that my funeral exinces and all my lawful debts be paid.

Item. I will and direct that one years maintenance for my family out of the grain meat cloth flax wool that may be on hand or coming to hand at the time of my discease, be set apart for their use without any appointment or accompl made of it

Item, I advise & direct that my family live together on the place and make the best use of it for the common benefit as long as they and their guardians shall deem it expedient for them as a family.

Item. I will and direct that stock sufficient to carry on the business of the farm be left to my family, for their common benefit, as long as they shall live together.

Item, I will to my beloved wife Agness one third of my moveable property, after the aforesaid deductions.

Item, I will that the remaining two thirds part be equally divided among all my children.

Item, when it shall be deemed inexpedient (as before directed) for the family to live together I direct that my land be sold and that the price of it be divided equally among all my heirs, including my wife Agness, provided she shall remain in her widowhood, -and provided, all my sons shall have continued to work for the common benefit of the family an equal term of time but, if one or more of them shall have wrought a year or years longer than the others a due allowance of wages shall be made to them for the sd time.

Lastly, I nominate and appoint my trusty friend William Hughes, Esq, sole Executor of this my last Will and Testament. Signed, Sealed and publickly declared, this twenty third day of February in the year of our Lord one thousand eight hundred and eleven. Samuel Caldwell (Seal)

Be it remembered that on the sixth day of April, in the year of our Lord, one thousand eight hundred and eleven, before me, Isaac Kerr, Register for the probate of Wills and granting Letters of Administration in and for said County, came Thomas Gordon and Samuel Caldwell, the subscribing witnesses to the within Will and Testament of Samuel Caldwell late of the county aforesaid, deceased, who, being duly sworn as the law directed, do depose and say that they were personally present and did see the Testator therein named sign the within Will and did hear her publish, pronounce and declare the same to be his last Will and Testament; That at the time of his so doing, she was, to the best of their apprehensions, of sound disposing mind, memory and understanding; And that they respectively subscribed their names as witnesses to this will, in the presence, and at the request of the Testator, and in the presence of each other.
