Biography

Mary Ann Hitt, daughter of Harmon Hitt and Mary Ann Weaver, was born April 9, 1759 in Fauquier County, Virginia. She married Charles Ayres on April 9, 1778 in Fauquier County, Virginia[1][2][3], permission given by Mary's father Harmon Hitt. Mary passed away in Fauquier County, Virginia between 1834-1835.

Mary Ann Hitt b. April 9, 1759 m. Charles W. Ayers. Fauquier Marriage Bonds, Vol. I, p. 72, shows the marriage bond of Mary Hitt and Charles Ayres April 9, 1778, with the consent of her parents, Harman and Mary Hitt.

Fauquier County, Virginia Land Deed Book 33, page 270[7] To all whom it may concern. Whereas Charles Ayres late of the county of Fauquier and state of Virginia by his last will and testament now of record in the office of the county court aforesaid, amongst other things did bequeath unto us Mary Ayres the widow and Mary Ayres the daughter of the said Charles Ayres, Certain slaves to dispose of in any way they may think proper, which slaves are therein designated as having come to him by his father-in-law and names(Diner, Daniel, and Hannah). Now know ye that we the aforesaid Mary Ayres widow and Mary Ayres Daughter of the said Charles Ayres dec'd both of the county and state aforesaid do hereby emancipate and set free one of the aforesaid slaves named Daniel who is hereby released to be entirely and fully discharged from any and every obligation of slavery by descent and from the performance of any contract entered into during servitude and to enjoy as full freedom as if he the said Daniel has been particularly named and freed by and act of the General Assembly. In witness whereof we have hereunto set our hands and seas this 24th day of December eighteen hundred and thirty-two. Witness Wim Rawlings, Ezekiel Glasscock. Signed Mary Ayres, Mary Ayres At a court held for Fauquier County on the 29th of January 1833 this deed of Emancipation was presented in court by the oaths of Wm Rawlings and Ezekiel Glasscock witnesses thereto and ordered to be recorded. Fauquier County, Virginia Land Deed Book, page 284[8] Whereas Charles Ayres deceased late of the county of Fauquier and state of Virginia by his last will and testament duly proved and recorded in the office of the County Court of Fauquier did bequeath to his wife Mary and his daughter Mary to dispose of in any way they may think proper, certain property therein mentioned including three slaves that came by his father-in-law viz(Diner, Daniel, and Hannah) Now this indenture witnesseth that we Mary Ayres wife and Mary Ayres daughter of the said Charles Ayres deceased of the county and state aforesaid do herby emancipate and set free the aforesaid slaves Diner and Hannah and also Mary Jane an infant daughter of Hannah, born since the aforesaid bequest was made, together with all their increase. Who are herby severally or individually entirely and fully discharged forever from the performance of any contract entered into during servitude and from any obligation of service or slavery whatever and shall or may enjoy individually as full and perfect freedom as if they had been particularly named and freed by an act of the General Assembly of the State aforesaid. In witness whereof we Mary Ayres wife and Mary Ayres the daughter of the said Charles Ayres dec'd have hereunto set our hands and seals this 1st day of February 1833. Witnesses Hugh Brant, Ezekiel K Glasscock, John W Hitt Signed Mary Ayres and Mary W Ayres. At a court held for Fauquier County on the 25th day of February 1833. This indenture was proved in court by the oaths of Ezekiel K Glasscock and John W Hitt witnesses thereto and ordered to be recorded. Test A J Marshall C.C.

Will of Charles Ayres

Fauquier County, Virginia Will Book 11, pages 377-380, written October 31, 1828 and proved in court on July 28, 1829.[9] In the name of God amen, I Charles Ayers of Fauquier County and State of Virginia, being weak in body, but of a sound mind, memory and understanding do make and publish this my last will and testament in manner and form following viz; In the first place it is my will and desire that all my just debts and funeral expenses be paid out of my estate at the discretion of my Executor hereafter to be named. Item I give and bequeath to my beloved wife Mary and my daughter Mary, all the tract or parcel of Land on which my house now stands and purchased of Jno Carr containing on hundred and sixty acres, to have and to hold the same during their natural lives and after their death to fall to my grandson Charles R Ayers, his heirs provided he shall live to the age of twenty one years and should he not live to the age of twenty one years, then to be sold by executor and the money equally divided between Elizabeth Green, Nancy Massie, Margaret Smith, their heirs. I also bequeath to my beloved wife Mary and my daughter Mary to dispose of in any way they may think proper all the household and kitchen furniture, beds and bedding, with all and singular goods belonging to my house and also three slaves that came by my father-in-law. Viz Diner, Daniel, and Hannah. Item it is my will and desire that all my land (except the above named), stock, farming utensils, etc be sold by my executor and the money after discharging all my debts as above applied as follows viz. First to my Granddaughter Rebecca H Ayres five hundred dollars and no more, to the residue of children of Daniel Ayres dec'd and Rebecca Morrison dec'd heirs living each fifty dollars and to my grandson Charles R Ayres one hundred dollars. Item it is my will and desire that all my slaves(except the above named and one viz Maria which I will to my Grandson Charles R Ayres, be equally divided between Elizabeth Green, Nancy Massie and Margaret Smith their heirs. Item it is my will and desire that provided there should be a surplus of money remaining in the hands of my executor after having discharged all my debts and bequests that said surplus be by him equally divided between the above named legates. Item it is my will and desire that so long as Catherine A.M.. Ayres remains a widow she be allowed out of my estate twenty dollars annually for the support of herself and child. Item I give and bequeath to my daughter Sarah Bathrope and her heirs one shilling and no more. Item and lastly I nominate and appoint John W Hitt my sole executor to this my last will and testament, herby revoking and making vow any and every will or wills heretofore by me made. In witness thereof I have hereto set my hand and affixed my seal, this thirty-first day of October one thousand eight hundred and twenty eight. Singed Charles Ayres. Signed, sealed, published and released by the above named Charles Ayres to be his last will and testament in the presence of us who at his request and in his presence have hereunto subscribed our names as witnesses to the same.
