David Lively was born circa 1760 and was residing in Spotsylvania county, Virginia at the time of the American Revolutionary War. He chose not to serve in the military (probably for religious reasons - see researchers notes) and furnished a substitute by paying Philip Carter to serve in his behalf. [1]
David Lively is honored by the Society of the DAR as Ancestor #A212482. DAR records indicate that David died after April 5, 1824, in Spotsylvania county, Virginia and that his wife's name was Polly Carter. Applications for membership in the Society of the DAR have been made by the descendants of their son, David Lively, Jr. who married Ann Elton White; and of their daughter Mary "Polly" Lively, who married Jonathan Durrett. Revolutionary War pension application files were primarily created as a result of legislation enacted by Congress between 1818 and 1855 [3] Philip Carter called witnesses to testify that he had served on behalf of multiple persons during the war. On October 15, 1832, Joseph Carter appeared before a Justice of the Peace in Barren county, Kentucky to testify that Philip had served in the military as a substitute for his father, John Carter, and his brother-in-law, David Lively. David Lively was located in Fredericksburg, Spotsylvania County, Virginia in the 1820 census. Sons Chilian and David were also listed.
While some do not realize that the Daughters of the American Revolution have many DAR Ancestors that did not serve on active duty, there are actually quite a number of men and women, too, that furnished supplies, or fulfilled their duty to their country in various civil service manner. Their descendants are eligible to join the Sons and Daughters of the American Revolution.
David would have been known in modern day terminology as a "Conscientious Objector" because he died not wish to take up arms against another in an act of War. He is likely a descendant of Moses Lively Lively-1249 who was a member of the Society of Friends, also referred to as "Quakers."
