According to Thomas H Surr and his cousins Amy and Donald Surr (and family verbal history): James was murdered. he was found in a canal, and his body had marks on his head, said to look like the heel of a woman's shoe.

Location of his death was Forth and Clyde Canal.[9] Christina Paterson was the name of the woman who was with him.
James is rumored to have an illegitimate child. According to family history, at some point after James' death, a woman came to the Surr’s door with a small child who looked very much like their youngest child (Fred), claiming that James was the father.
