On January 1, 1824, Chunky John Mullins purchased a 100-acre tract of land from James W. Little for the consideration of $350 cash. The land, originally belonging to John Preston, lies on Shelby Creek beginning at the mouth of a gut being a conditional line between Booker Mullins and James Mullins and runs up the meanders of Shelby Creek to the mouth of the Long Fork, then runs up both sides of Shelby Creek as far as the mouth of a sandy gut being a conditional line between Booker Mullins and David Mullins including all of the land between the lines of the boundary. The deed was sealed by James W. Little and attested by William Tackett, James Roberts, and Reuben May. It was recorded October 27, 1824 by Spencer Adkins, Clerk of the Pike County Court.[1]
On July 3, 1824, Chunky John Mullins purchased a 50-acre tract of land from John Mullins Sen. in consideration of $120 cash. The land lies on the Caney Fork of Shelby Creek and was first granted and patented by the Commonwealth of Kentucky to Richard Damron, and borders the residence of James Roberts in the northwest corner and "Madison's line." The deed was sealed by John Mullins (Sen.) and was attested by James Roberts, William Mullins, and Cornelius Roberts. It was recorded October 28, 1824 by Spencer Adkins, Clerk of the Pike County Court.[2]
On November 22, 1825, Chunky John Mullins sold the 100-acre tract of land on Shelby Creek to Elisha Johnson for the sum of $290 cash. It was recorded November 22, 1825, the same day, by James Honaker, Clerk of the Pike County Court.[3]
On March 9, 1827, he sold a 50-acre tract of land to David Branham for the consideration of $300 cash. The deed was signed by Chunky John and Thomas May, and attested by James Roberts, William Robinson, and William Branham. It was recorded the "1st day of March," 1827 (this must be a clerical or transcription error, because a deed cannot be recorded before the fact.), by James Honaker, Clerk of the Pike County Court.[4]
Chunky John's will was published January 4, 1847 and delivered to H. C. May and Thomas May. In it, Chunky devises to Elizabeth, his widow, all of his real and personal property for the remainder of her natural life. If she should marry again, then his widow Elizabeth was to have a third of his estate. Upon her death, he willed that the remainder of his estate be equally divided among three of his children, namely William, John, and Elizabeth.
On May 17, 1847, Elizabeth Mullins, widow of Chunky John, produced his will at the Pike County court house in Pikeville. William Kirk and Nancy, his wife, and Jefferson Fleming and Letty, his wife, heirs of Chunky John, by their attorney, objected to the recording of the will but the objection was overruled. They then made a motion to have the cause continued, but the motion was overruled as well, and Chunky John's will was subsequently recorded as valid. Elizabeth on her motion was appointed along with John Mullins, Chunky's son, administratrix and administrator of his will, with William "Ball Head" Mullins acting as their security in the sum of $1,000.[5]
At a county court session held Monday, June 21, 1847, Elizabeth Mullins and John Mullins, Chunky John's widow and son, as administratrix and administrator, jointly made a motion to appoint William Tackett, John Mais [sic], James Damron, and John Damron, or any three of them after first being duly sworn, to appraise in current money the personal estate of the deceased.[6]
An Inventory and Appraisement Bill of the estate of the deceased was received by the county court in Pikeville at a session held September 20, 1847 and ordered to be filed.[7]
