18 August 1795 Deed Book 1, Part 2 Page 417 Source: FHL Film # 0034363 “Washington County, Virginia, Deed Books, Vols. 1 & 2 1776-1802” THIS INDENTURE made the eighteenth day of August in the year of our Lord one thousand seven hundred and ninety five between James Weir and Margaret his wife of the one part and John McQuown of the other part WITNESSETH that the said James Weir for and in consideration of the sum of one hundred pounds current money of Virginia the receipt whereof is hereby acknowledged the said James Weir hath granted bargained and sold and by these presents doth grant bargain and sell unto the said John McQuown and his heirs one certain Tract or parcel of Land containing one hundred acres be the same more or less lying and being in the county of Washington on a branch of the South fork of Holstein River granted to the said James Weir by a bargain and seal from Jonathan Weir on the thirteenth day of March in the year 1787, bounded as followeth, to wit, BEGINNING at a poplar and white oak in the South side of the Knobs a corner to William Spears part and with a line thereof, south fifty one degrees East one hundred and twenty eight poles to a poplar and white oak on the patent time thence on Gibson F---?-- line, South sixty four degrees west twenty two poles to a large black oak South thirty five degrees west forty poles to a white oak South eleven degrees west thirty seven poles to a white oak & beech, South thirty two degrees west seventy eight poles to a white oak and two s----?----, North thirty three degrees west fifty six poles to two white oaks. Appears in Alexander Montgomery's Precinct -- same precinct as James Berry -- and remains in that precinct until 1794/95 when he and Margaret sell their property to [1] Wm. Spear and [2] John McQuown. [double check, the McQuown sale might be a POA to James Berry] 1796 James Weir in Blount Co., Tennessee jury records Blount Co., Tennessee Deed Book 1 1795-1819 Page 4 Hugh Cochrun/Cochran to John Maxwell $100, land on waters of Pistol Creek, adj. James Wear, James Houston, Joseph Hart, Joch Cocerun, Charles McClung. Notation: "I assign over the within bill of sale Mathew Gilmore for full value rec'd this 3d day of Aug. 1799. Wit: Sp. Following from Military Service Records, NARA, Washington DC, "James Weir R 11287" 1715 Statement of Margaret Weir, wife of James Weir, Application for Pension: State of Tennessee} Blount County} On this 7th day of March 1845, personally appeared before me Saml. Pride an acting Justice of the peace in and for the County aforesaid Margaret Weir aged about eighty one years a resident of the county & State aforesaid, who being first duly sworn according to law doth, on her Oath make the following declaration in Order to obtain the benefit of the provision made by the act of Congress, passed July 7th 1858. That she is the Widow of James Weir who was a private in the army of the Revolution and entered the Service in Washington County Virginia, whether as a Volenteer or drafted she does not know, nor can she state the time of his entering the service, but believes that it was in the year 1780 or 1781 under command of Genl. Greene, and Col. Campbell. his first Captain she believes was Robt. Edmondson, though Lowry may have been the Captain he inlisted under, she recollects to have heard her husband speak of Edmondson and Lowry, though she is unable to recollect the order in which they came, nor can she state how long said James Weir served but thinks he was in service at and before the Battle of Kings Mountain and continued in service untill after the Battle of Guilford. That she has no documentary evidence in support of his claim, on account of her husbands Certificate of discharge having been burned up together with their dwelling house and almost every article of property they possessed, by the Indians, in the year 1788. that she does not know whether any other living Witness can be found, who could testify as to the services of the said James Weir than the affidavit annexed. She further declared that she was married to the said James Weir in Augusta County Va on the 19th day of February in the year Seventeen hundred and Eighty three. and that will appear more fully from the proof hereto annexed. she further states that the family record hereto annexed & marked (A) is the original family record and only one ever kept by herself and her husband, and contains the exact date of the marriage, together with Births of Children & c. and asked that it be taken as part of this declaration. That her husband, the aforesaid James Weir Died on the 11th day of March A.D. 1820. that she was not married to him prior to his leaving the service, but the marriage took place previous to the first of January Seventeen hundred and ninety four, viz: at the time above stated -- that she is a Widow at this time and had remained a Widow ever since the death of her husband aforesaid, as will more fully appear by refference to the proof hereto annexed. Sworn to and subscribed on the} day and year above written before me} Margaret Weir Saml Pride} Justice of the peace}

F. Milwee of Houston, Texas referring to the file and stating that Margaret's claim was not allowed, as she failed to furnish proof of six months' service, as required by the pension law. signed A. James Weir is the son of Hugh Weir & Margaret Elizabeth (McEwen) Weir. He was a Revolutionary War Soldier who served with Colonel Campbell's Virginia Regiment at the Battle of Kings Mountain and at the Battle of Guilford Courthouse.

On February 19, 1783, James married Margaret "Peggy" Sharp, the daughter of John Sharp. Application for Revolutionary War Pension was submitted by his widow, Margaret Sharp Weir, The children she had by James Weir were named in the application. [10]

James Weir enlisted in the Army of the Revolution in Washington County, VA and according to his widow's pension application, he served "under the command of General. Greene and Col. Campbell" and "he was in service at and before the Battle of Kings Mountain and continued in service until after the Battle of Guilford." His name appears on a DAR monument to Revolutionary War Patriots and Soldiers in Maryville, Blount County, and TN. James died on 3/11/1820 and is buried in the New Providence Presbyterian Cemetery in Maryville.

James owned land on Pistol Creek and lived on the Wright Ferry Road in what is now the Springbrook section of Alcoa, TN, north of Maryville. His widow applied for a pension on 3/7/1845 in Blount County (National Archives, Revolutionary War Pension File #R11287). She he

James Weir (1762-1820) was the Father of Anny Weir, Samuel Berry’s first wife.

He is also, the 7th generation grandfather of President George W. Bush. He fought in the Revolutionary War Battle of Kings Mountain in 1780.
