Charnock signed his will on 3 Mar 1751 in Westmoreland County, Virginia with his son-in-law, Samuel Rust, listed as executor. The will was probated on 26 Mar 1751 in Westmoreland County, Virginia. Mentioned in his will are sons: Presley, George; William, and daughter: Elizabeth Rust. Also mentioned are grandchildren: Peter Rust and Molly Rust.[10]

Some family trees show this Vincent Cox (Jr?) as a son of a Vincent Cox Sr. and wife Ann Charnock of England. Others show Vincent Cox as a son of Henry Cox and Martha Charnock of Bedfordshire, England.
Dr. Charnock Cox married Mary Presley, daughter of Peter Presley, Sr. and Elizabeth Thompson. Peter Presley was the son of William Presley and Jane Newman of Northumberland County, Virginia. Elizabeth Thompson was the daughter of Richard Thompson and Ursula Bish (Bysshe).
There are references to Cox being an Indian trader and interpreter. Many of these early Virginians had associations with the Native Americans.
William Deyo, official historian of the Pamunkey tribe of Virginia, wrote: "I also descend from Charnock Cox, grandson of Vincent Cox, the immigrant. I have followed several lines down from Vincent who used the given name of "Fleet" other than the descendants of Presley Cox [son of Dr. Charnock Cox] who married a Fleet. People would not have named a son "Fleet" without a descent from that family. I am convinced that Vincent's wife was a daughter of Henry Fleet by a first wife, who was an Indian. Henry was captured by the Anacostan Indians when they killed Henry Spelman. He was a young man and lived with them for a number of years. It is only logical to believe that Henry had an Indian wife during that period or at least fathered children by an Indian woman during his captivity. That would explain why Presley Cox was even associated with the Fleets way off in Lancaster County and likely married his cousin. Vincent was an Indian interpreter and kept an Indian boy like a slave until he was forced to release him. The Indian boy was named William King and was probably the same William King later in Stafford County who left descendants. "Henry Fleet was also an Indian Interpreter and was the guide for Father Andrew White in 1634 when he visited the Patawomeck Tribe."
Charnock Cox, Sr. and Mary Presley Cox had the following known children: Charnock Cox, Jr., Col. Presley Cox, William Cox, Peter Cox, Molly, and Elizabeth Cox. Some also show Martha as a daughter; others show "Martha (Molly)". In his will dated 3 Mar 1751 (probated 26 Mar 1751)Charnock Cox, Sr. leaves his estate to his children and his wife, Elizabeth. Executor of the estate is his son-in-law, Samuel Rust, husband of his daughter Elizabeth.
16 March at Court last it was ordered that Vincent Cox and Charnock Cox, executors of Vincent Cox, should return a division of the estate of Vincent Cox made by Henry Ross and Alexander Spence, Gent., together with a perfect inventory and account of the estate, which order not being performed, was continued returnable to this Court and now also faileing t o perform the same, it is ordered that the Sheriff doe take Vincent Cox and Charnock Cox into custody until they perform the order.

In the name of God amen I Charnock Cox of the Parish of Copley and Coun ty of Westmoreland being sick and weak of body but of good and perfect s ence and memory thanks be to God and calling to mind the uncertainty of t his transitory life do make and ordain this to be my last will and test ament and as to my worldly Estate it has pleased God to endow me with a fter my just debts be paid I give and dispose of in the following manne r. Imprimis I give unto my Son Presley Cox my Desk and Book Case & larg e bible that is at his house. Rust his Executor s therein named who made oath thereto and being also duly proved by the oaths of Leazure Hall & Vincent Cox two of the witneSses thereto is admitted to record, and upon the motion of he said Executors and their performing all such things the Law in Law in (sic!) such cases requires certificate is granted him for obtaining a Probate thereof in due form.
