Biography

Mary (Carter) Scruggs was born about 1725, in Henrico County, Virginia Colony. She was the daughter of Theodorick Carter and Elizabeth Unknown.[1] Mary was named in her father's will. She was unmarried at the time of her father's death, as her name appeared as Mary Carter in the will.[2].

Marriage and Children

Mary was married to Drury Scruggs, son of Richard and Martha Scruggs.[3].

Death and Legacy

Mary's will was filed at Cumberland County in 1804.[5] There is no mention of their dependent son, Carter Scruggs.[6].

Drury wrote his will on April 29, 1782, and it was proved on August 26, 1782.[7] He died at Cumberland County, Virginia. His wife, Mary, was appointed executrix, and she was appointed guardian to "Manage, do, and act" for their son, Carter Scruggs.[8]

Mary was born about 1728 ur 1738, daughter of Theodorick Carter and wife Elizabeth (Possibly Webb). Mary is named in her father's will, She was unmarried at the time of her father's death, as she is named as Mary Carter in her father;s will[5] WILL OF THEODRICK CARTER (FIRST In the name of God Amen I, Theodrick Carter of the Parish & County of Henrico being sick but of perfect Memory do this Twenty Second day of July one thousand seven hundred thirty six make this my last Will and Testament, and first and principally I commit my Soul to Almighty God in whom and by whose Mercy and thro. the Merits of my Blessed Saviour and redeamer Jesus Christ I trust and Assuredly believe to be saved, my Body to the earth to be decantly Buryed at the discretion of my Executx, hereafter named, and as for Disposing my estate I give and devise the same in manner and form following. I give and devise unto my Beloved wife Elizabeth so long as she shall live sole my plantation Land and Appurtenances and after her Death or Marriage, I give unto my Son Theodrick Carter and his heirs forever my said plantation with two hundred and eighteen Acres of Land thereto belonging. I give and devise unto my son John Carter and his heirs forever one hundred and Twenty acres Land be the same more or less within the following Bounds, beginning at a corner Beach standing on Round Hill Branch thence along a line of marked Trees to a corner Hickory on the Dividing line between John Spears and this line of John Webb to a corner Tree on Chickahominy Swamp thence up the same to ye place began at; my wife is not to be excluded the use of this Land so long as she shall remain sole, during which time, I give her my Negro named Will and after that time I give him to my son Theodrick with a Negro child named Dick. I give unto my son John and his heirs after the Death or Marriage of his Mother my Negro woman Judith and a Mullato Girl named Lucy with what children they may have when he has a right to the possession of them. I give unto my said Son John one fether Bed Rug and Blanket, one Gun, my great Chist, one pot and Hooks and two Cows. I give unto my Daughter Mary Carter one Cow and Calf one fether (sic) Bed, Rug and Blankets, two Ewes one pot and Hooks, two pewter Dishes and two plates and one poriager. I give unto my beloved wife Elizabeth all the rest of my Estate of what kind so ever and do make her Executrix of this my last Will and Testament, hereby directing that my Estate shall not be Inventoryed (sic) or appraised. In Witness whereof I have hereunto set my hand and Affixed my seal the day and year afore written.

At a Court held at Varina for the County of Henrico, the firsrt Monday in Ap'l 1737, this Will was presented by Elizabeth Carter the Executrix upon oath and proved by the Oath of Thomas Watkins & John Spear two of the Witness thereto and thereupon admitted to record, and on the Motion of the said Excutrix, Certificate is granted here for obtaining a probate thereof in Due form. Test: Bowler Cocke,Cl, Cur.
Her mother Elizabeth Carter, relict of Theodorick, l named only the daughters and one son, John, her executor in her will[6] - p. 44/97 - Will of ELIZABETH CARTER, RELICT OF THEODORICK CARTER To: son, Theodorick - 6 head cattle, great Bible and white mare dau, Elizabeth Martin - items and livestock dau, Susannah Scruggs - items and livestock dau, Martha Garthright - items and livestock dau, Mary Sough( {Scruggs-transcription error) - items and livestock grandson: Cuthbert Web - livestock All the rest to son John Carter and he to be Executor. First, I give and bequeath to my son Edward Scruggs and his heirs forever three horses called Mich, Blake and Black Mare ; and all the cattle and sheep of any description which to me belongs also the furni- ture of my beds except what may be hereinafter given to others.

I give to my daughter Nancy Minton one bed and furniture.

I give to my daughter Frances Anderson the Cow and Kettle, which I have heretofore lent to her.

All other interest which I have of any discription in any kind property or estate whatsoever. I give t'.^ my son Edward Scruggs.


Published and acknowledged in presence of William Daniel Jr. Vincent Scruggs.

Unknown-499944 and Carter-1914 appear to represent the same person because: I am sure these are the same people, Mary Carter, daughter of Theoderick Carter and Elizabeth (possibly Webb but not proven). She married Drury Scruggs in 1747 probably in Henrico County Virginia but those records have been lost. She wrote her will in 1803, and it was probated in 1804. She is named in her father's will as Mary Carter, indicating she'd not yet married. She's named in her mother's will, though transcriptions have it spelled Sough instead of Scruggs. However, Mary and Drury's children indicate this is correct. They were Theodorick, Edward, Carter, Jane (m. Wm Easley), John, Drury Edward Scruggs, Ann "Nancy" m. Wm Minton, Frances "Fanny" Scruggs m. Richard Anderson. Theoderick and Mary Carter Scruggs are my 6th great grandparents. Mary is not unknown. She had parents, a husband and children. I come from Drury Edward Scruggs b. 1 Feb 1724/25 St. Peter's Parish, New Kent Co VA d. 1782 in Cumberland County Virginia. . Mary was born about 1725 and died between the writing of her will in 1803 and its probate in 1804 which I added to Mary Unknown's profile.

Carter-1914 Unmerged match

These profiles have much in common, but Mary Carter was only Mary not "Mary Elizabeth," according to sources I have seen. She may have had a sister named Elizabeth. Please have a look, and see whether these might represent the same person?
