  • The will of Anne Keats names two sons, Edmund Waller, Esq., of Gregories in Co. Bucks and John Waller, of London, Merchant. here is a reference to John (Merchant) in the Calendar of Treasury Papers dated in 1695 p.458
  • Since Dr. John Waller, Gentleman (died 1723), apparently lived his entire adult, married life in Newport Pagnell, Buckinghamshire, and was trained and evidently worked as a doctor, It seems logical and obvious that he is not the same person as Anne Keat's son, John Waller, of London, Merchant, who occurs in records of 1695 and 1706.
  • Further research into actual parish records to establish parents of Dr. John is in order to establish validity of prior claims. It is more likely Mary died before 1716 Will as she was Not Named as a beneficary or an executrix; Dau Jemima inherited all (un-entailed) personal property and goods and was Executrix of will. Benjamin was primary Heir and Executor; Edmond a Dr. in Cambridge -- William a Minister at Walton (nearby parish);

Mr. Waller was buried Febry. 25, 1750/1.” (The will of William Waller, rector of Walton, Bucks; dated October 26, 1747; probated March 28, 1751; recorded Prerogative Court of Canterbury, 100 Busby.) Lips­cornbe, The History and Antiquities of the County of Buckingham, Volume IV, page 387 states that “William Waller, A.M. who was presented 23 June I711 [to rectorship of Walton, Bucks] by John Waller, Gent. an Attorney of Newport Pagnell. He died 18 Feb. 1750, aged 8o years, and was buried 25 Feb. in the church-yard, under the east window of the chancel.” The item in Lipscombe does not state that “John Waller, an Attorney” was the father of William Walton, whom he presented to the rectorship of Walton. He may, however, have been the father of the rector as surmised by Dr. John G. Herndon in his Waller note in William and Mary Quarterly, Second Series, Volume 22 (July 1942), page 313.

In The Name of God Amen the twenty first day of August in the third year of the Reign of our Sovereign Lord George by the Grace of God of Great Britain France and Ireland King Defender of the Faith . . .Annoqui Domini one thousand and seven hundred and sixteen, I John Waller of Newport Pagnell in the County of Bucks Gent. being in health of body and of a sound and perfect mind and memory praise be given to Almighty God for the same do make and ordain this my last Will and Testament in manner and form following that is to say First and principally I commend my soul into the Hands of Almighty God my heavenly Father by whom of his meer and only Grace I trust to be saved and received into eternal rest through the meritorious passion Resurrection and Ascention of my ever blessed saviour and Reedeemer Jesus Christ and my body I commit to the Earth to be decently interred and laid in that vault of Monument which I caused to be built on the Southside of the Church of Newport Pagnell aforesaid at the bottom of the Hill near the River Wall and fenced it about with Iron Rails and a Gate and built first for my dear Son James and remains for a burying Place for myself and those of my Family of the Wallers forever when it shall please God to call them And as for the worldly Estate where with it hath pleased Almighty God to bless me I dispose thereof as followeth.

THE POET [Edmond Waller] writes of the happy return of Charles the Second.

Hammers resound with the restoration of churches throughout the width and breadth of the land. This England, tired of long years of curfewed nights, tired of wineless dinners, tired of puritanical living, welcomed back the gay and gallant Charles the Second and went about with alacrity to wipe from their lives all trace of Cromwell. England's colonies changed governors and the great upper middle class gave more thought to these colonies, a rich source of revenue and expanseless territory for the settlement of young colonists. Yea! More and more thought was given to America. This was England; and her ships plying the seven seas over which she was undisputed mistress.
Lying in the south-centre of this land is Buckinghamshire; adjoining London and bounded on the south by the river Thames. Drained by the Ouse, near the centre of this shrine, referred to as Bucks, lay the Hundred of Newport. Pagnell is nearly in the centre of the Hundred and thus in the heart of England. The great road to Liverpool passes through Pagnell and is in some parts dead flat with hedgerows on either side; though occasional glimpses of the surrounding country-side may be had and a church spire appears between great branches of English oak.
The Church of Walton parish, dedicated to St. Michael, was already an old edifice, irregular and consisting of a square tower, a nave and chancel when our story begins. The low ground on which the church stands in this flat country-side causes it to be excessively damp, giving it a sombre air. So we find Walton, Bucks, England, in 1669.
On a winter day of that year - January 13, to be exact - came John Waller and Mistress Mary Pomfrett to Walton, to be married. Of Mary Pomfrett little is known. We learn that William Promfrett A.B. was vicar of Astwood, May27, 1689 through December 21, 1704; and that Mr. Benjamin Pomfrett, of Newport Pagnell, purchased of Sir William Tyreyham, Knt., the right of advowson; while later, Robert Pomfrett was rector of Emberton from April 30, 1753 until 1804.
Apparently John Waller and his wife resided in Newport Pagnell for in the register of that parish we find the births of their numerous children recorded. The family of Waller is one of the most ancient and distinguished among English ancestry. There is an unbroken male line from William the Conqueror's time down to the present time. An English genealogist claims to have traced the name back to the sixth century.
The English speaking branch of the Waller's was founded by two brothers, John Henry David de Waller and Alfred deWaller, Norman's, who came into England with William the Conqueror the year 1066 and fought with him at Hastings. John Henry David Waller was given lands in Nottingham County;Alfred in the County of Kent. The American Branch traces descent from Alfred de Waller of Kent, who died in 1083 (Domesday Book)

Conway, he came to Virginia about 1635, locating in New Kent County. He brought with him a seal bearing the arms of "Waller of Kent." He received a grant for 126 acres in Gloucester County, dated February 20th, 1667. Together with his brother, William Waller, and Gerard Martin he received another grant for 800 acres in Stafford County, dated July 2nd, 1669. He married Mary Kay or Key.

[SOURCES - SUSPECT - CONFLICTS WITH RECORD PROOF] Patricia Watkins-Schmidt - Oct 24, 2001 John Waller is a descendant of William 1 the Lion, King of Scotland I have also read that in "Dr. John Wallers Will", probated in England after his death does show the sums and properties left to his children including our Mary Waller that his son John Waller received little as Dr. Waller had already provided his son with monies to come to Virginia and buy the land that he did. Now, I go with his will that Dr. John Waller married to Mary Pomfrett died in England as that is where his will was probated.

[schmidt] Oddly enough, my husband and I were visiting Bellfield Plantation the day after Christmas and discovered an underground burial vault.This vault was not previously known about. The Bellfield Plantation is on Navy Property, but leased by the National Park Service. This is important because the Navy is responsible for the follow through. Navy Archeologist have been to Bellfield and have tentatively dated the casket to the late 1700's to mid 1800's and feel it is a Digges family member, female or a child due to the size. The body is enclosed in a cast iron casket which meant the individual was of prominence. I do have pictures of the vault, but can not send them to you at this time due to security concerns by the Navy. They are protecting the vault and fear looting may take place. I will keep you updated on this situation if you like. I do have a picture of Edward Digges Crypt that is located on Bellfield Plantation if you like. The Plantation is now closed to the public. [Dr John] "John Waller was apprenticed 23 Jun 1658 to the Barber Surgeons Company; was admitted to Freedom 06 Feb 1665; admitted to St Catherine's College, Cambridge 10 Jun 1664 M. B. 1667; Married at Walton, Bucks, Eng13 Jan 1669 to Mary Pomfrett of Newport Pagnell,Bucks. One of the functions of the Barber Surgeons' Company in the 17th century was closely analogous to that of a medical school of today. After nearly seven years training there John Waller was a master surgeon. Before achieving his freedom (somewhat similiar to saying, before he was admitted to practice) he entered St. Catherine's College, Cambridge, and after three years there he received his degree, which in the record is printed as the M. B. which seems to be erroneous to M.D. degree being probably intended. The Cambridge Alumni directory incorrectly states that the father of this John was John Waller , a clothier, of Braintree, Numerous errors are contained therein as to relationships, Mr. Glencross himself is mentioned therein as calling attention to certain of them. Nearly all the writers on the subject of Waller genealogy have agreed that Colonel John Waller, who was of 'Enfield' King William County Virginia, and later of' Newport' in Spotsylvania, was the son of Dr. John Waller, of Newport Pagnell,Bucks, Eng. They are, moreover, completely justified in making this assumption since the arms on his tombstone are identical with those which Dr. John Waller, of Newport Pagnell, Bore, and his Spotsylvania plantation was doubtless named "Newport" in memory of the place of his birth in England. They have usually, however, stated that Dr. John Waller's wife was Mary KEY or Kay). concerning that Mr. Glencross has written: 'With regard to Dr. John Waller who, you say , married Mary Key, I have found no such marriage.' [This seems to be error Per Will Transcript] Dr John Waller's will was probated in 1723 in the prerogative Court of Canterbury: In it he refers to his eldest daughter Mary, and son John, as being then in Virginia, Dr John's widow Mary (Pomfrett) came to Virginia, for as early as 03 Nov 1724 she made her home with either her son, Colonel John Waller or her daughter, Mary (Waller) Herndon.'"


[SUSPECT SOURCE - Likely Error] Burke's Landed Gentry states that "John Waller (1617-1688) of Newport,Pagnell, Buckinghamshire, youngest brother of Edmund Waller, thecelebrated poet, . . . left England and settled in New Kent County,Virginia, 4 July 1635." Also, John Waller's wife, Mary, returned temporarily to England for the birth of her son, Colonel John Waller(1673-1754). The latter was the father of Judge Benjamin Waller.

John WALLER M.D. was born about 1645 at Newport Pagnall, Buckinghamshire, England and wrote his will there on 21d 8m 1716. The parish records there do not show a baptismal or a burial record for him. [11]

JOHN WALLER, Gent., of unknown parentage. � He was admitted sizer at St. Catharine’s College, Cambridge University June 10, 1664, and obtained a Bachelor of Medicine degree in 1667.
� He married at Walton, Buckinghamshire 13 Jan. 1669 MARY POMFRETT.
� [Conflicts] They had nine sons, Leonard, [Rev.] William, [Col.] John, Thomas, Stephen, Benjamin, [Dr.] Edmund, M.D., James, and James (again), and two daughters, Mary and Jemima.
� He occurs on a list of the inhabitants of the high Town of Newport Pagnell, Buckinghamshire in 1672 as “John Waller Gen.”
� In 1690 William Thorpe, of Newport Pagnell, tanner, and Elizabeth his wife gave a lease to John Waller, of Newport Pagnell, Gent., and Mary his wife for a messuage where William Thorpe now dwells in the Marsh end, Newport Pagnell.
� In 1697 Anthony Chibnall, of Sherington, Gent., and his son and heir, John Chibnall, of Sherington gave a mortgage bond to John Waller, of Newport Pagnell, Gent.
� As “John Waller, Gent.,” he presented his son, William Waller, A.M. to the rectory of Walton, Buckinghamshire 23 June 1711.
