Daniel Shumate Sr was a Virginia colonist.

Daniel was the son of John Chaumette and Judith Bailey, born about 1730 in Stafford County, Virginia Colony (became Prince William in 1731 and Fauquier in 1759).

Daniel's grandfather Jean Baptiste Chaumette, a Hugenot, fled France for England after the Edict of Nantes was revoked by Louis XIV in October 1685. The Edict had been issued on 13 April 1598 by Henry IV and granted Calvinist Protestants of France (known as Hugenots) substantial rights in a largely Catholic nation. When it was overthrown, thousands of Hugenots left France because of increased hostility and persecution. Jean went first to England, then to Martinique and finally, with three of his sons, to Virginia where he settled in Stafford Co. about 1720. One of the sons (who Anglicized his name), John de la Shumate, was born about 1708 in England, possibly in London. He married Judith “Judah” Bailey about 1728 in Stafford Co. Daniel Shumate was their second child, born about 1730, not earlier.[1]

The Broad Run Baptist Church was constituted 3 December 1762 in Fauquier County, Virginia. Among the founding members were Peter and Sarah Cornwell. Mary Shumake [Shumate] was added to the church by baptism on 12 August 1764. On 18 August 1769 a list of current members was published in the Church Minutes. Included are: "... Peter Cornwell (deceased), Sarah Cornwell ... Mary Shumake [Shumate] deceased ...."[2]

A later entry in the Church Minutes (about June 1785) states:

The Church of Jesus Christ at Broad-Run holding believers - baptism & was constituted Dec 3d 1762, by Mssrs John Marks & David Thomas it then consisted of 10 members. All of whom are since removed by dismission or deaths, only excepted viz Edmund Hayes, Elizabeth Hayes & Sarah Shoemack [Shumake/Shumate]. (Sarah, widow of Peter Cornwell, has been married to Daniel Shumate for almost ten years.)

It is interesting to conjecture that it might be through this church that Daniel Shumate met and later married the widow of Peter Cornwell after his own wife Mary passed on.

Daniel owned and farmed a tobacco plantation throughout his life with the assistance of several slaves, including one belonging to his son-in-law John Parris and one belonging to Daniel's son William who were named in his will.

Daniel was named in the will of his father Jean Chaumette. Reference is made to property given to Daniel and his siblings during Jean's life and nothing further will be given to them until after the death of Jean's wife, Judith (Bailey) Shumate. The remaining estate then to be divided among these children: William, John, Joshua, Daniel, Thomas, James, Bailey, Lettice and Jemima.

Marriages & Children

Daniel married Mary Unknown about 1748 in Prince William County, Virginia. No marriage record has been found, however they had seven known children. It is difficult to determine accurately when the children were born, but these dates are generally accepted.

Mary Shumake [Shumate] passed away before 18 August 1769 in Fauquier County, Virginia.[2] Daniel married his second wife about 1777 in Fauquier County, Virginia.

Daniel married second Sarah Ann (Bowling) Cornwell, widow of Peter Cornwell, sometime after Peter's death about 2 June 1776 and before 26 May 1778. They had no children.

When Court was held on 26 May 1778 in Fauquier County, it was ordered that Sarah Ann Shumate, late widow of Peter Cornwell, deceased, receive her dower in the land and slaves, and also a child’s part of the personal estate left by Peter Cornwell. John Cornwell and Simon Cornwell, sons of Peter, objected by Andrew Buchanan their attorney. But the court overruled the objection. [3]

There is no evidence that Daniel was every married to Sarah Ann James. There is no evidence this woman ever existed. She has been removed as Daniel's wife. Shirley Dalton 14:41, 17 March 2020 (UTC)

Death & Legacy

Will dated 29 January 1806, Leeds Parish, Fauquier County, Virginia and entered for probate on 24 February 1806.

"In the name of God, Amen. I, Daniel Shumate of Fauquier County of Leeds Parish being weak of body but of sound and disposing mind and memory, do make and ordain this my last will and testament in Manner and form following, that is to say, first I commend my Soul to God its creator in all humble hope of its future happiness through the only merits of my blessed Lord and Savior Jesus Christ, and my body to the ground to be decently buried at the discretion (SIC) of my executors hereafter named and as to worldly estate which God has been pleased to bless one with, I give and bequeath as followeth.

"Imprimis. I give and bequeath to my beloved wife Sarah Ann Shumate one feather bed and furniture, one Negro fellow name Jo and all the corn and provisions now in my possion (sic) for the support of the plantation this year to her and her heirs forever. It is also my Will and desire that the negro fellow belonging to John Paris and the negro wench belong to my son William after my death shall remain on the plantation this year as my sons Mark and William promised me if I rented a plantation and began a crop they should do so.

"Item. The rest of my estate after the rent and my just debts are paid and one third part given to my wife are to be equally divided between my daughters Judah Paris, Duanna Johnston, Dinah Luttrell and my son Samuel Shumate but in case John Paris takes his negro away his wife is to have no part of it and to be divided between the other three.

"Lastly, I nominate and Appoint my son William Shumate and John Parish executors of this my last will and testament hereby revoking all others by me here to fore made.

Signed, Sealed and Acknowledged to be the last will of the Testator in presence of us 29 Jan 1806: Joseph Blackwell, John (X), Winn Jemima (X) Winn [Sister of Daniel II]

"At a Court held for Fauquier County the 24th day of February 1806. This will was proved by the affirmation of Joseph Blackwell and the oath of John Winn witnesses thereto, and ordered to be Recorded. Teste: H. R. Campbell,cl"[4]

  • 25 November 1782 - On the motion of James Cornwell It is ordered that Moses Johnson Jeremiah Bogess Daniel Shumate and Rowley Smith or any three of them being first sworn do view the most convenient way for a road from William Days across the Rappahannock mountain to the said Cornwells mill and report the conveniences and inconveniences attending the same to the court.[7]
  • 1783 - Tax list 1783, Fauquier County, Virginia: there are two Daniel Shumates listed, one of them is probably this Daniel.[8]
  • 1 May 1786 - "At a Court held for Franklin County the first day of May: 1786 ... A Deed Daniel Shumate to Jacob Miller Prov'd & O R.[9]
  • January 1793 - Daniel was appointed one of the appraisers for estate of James Headley. Inventory returned to court on 25 February 1793. [10]
  • 15 February 1806 - Daniel transferred property to son William Shumate "for and in consideration of the Natural Love and affection which I bear to my son William Shumate ... as weel as for the further consideration of one dollar to me in hand paid by the said William Shumate ...." Property transferred: "...one Negro woman named Sarah also one girl named Edy, likewise one girl named Hannah...."[11]
